A Texas woman is bringing her disability insurance claim into federal court, seeking long term disability denied by Unum.
According to her Unum claim denial lawsuit, her long term disability was denied based on false or biased information. She claims disability insurance giant Unum denied her even though she met all eligibility requirements.
Plaintiff Delois B. had been previously fully employed at Baylor Scott and White. As an employee of that firm, she was supposed to be provided with long term disability coverage if she ever needed it.
In March 2016, Delois claims, she had reportedly become totally disabled and had to cease working. Delois says her disability has since prevented her from gaining full employment in a similar occupation, and she has not been able to earn sufficient income.
Delois promptly filed for long term disability benefits with Unum, but Unum denied that claim. She went through the company’s internal appeals process, but still Unum would not grant her benefits.
Having exhausted all her administrative remedies, Delois has now filed this Unum lawsuit, hoping the court will grant her the long term disability benefits denied by Unum.
Deolois alleges Unum had relied on biased and unreliable medical evidence, or other claim denial tactics, to wrongfully deny her claim. She accuses Unum of selectively ignoring relevant evidence. She alleges that Unum operates under a conflict of interest that had a significant influence on the denial of her claim.
Overview of Unum Claim Denial Allegations
Unum Life Insurance Company of America is one of the largest disability providers in America, serving over 17 million policyholders. Unum is supposed to provide short and long term disability benefits to policyholders, and is often contracted by different businesses to be their insurance provider.
Even though it is one of the country’s main disability providers, Unum has been accused of using aggressive claim denial tactics for years against policyholders. The claim denial often mentioned in Unum claim denial lawsuits include:

- Improperly investigating claims and obtaining opinions from unqualified third parties
- Misreading medical records, often by unqualified third party medical examiners
- Repeatedly demanding for independent medical examinations or denying claim without medical examination
- Refusing to acknowledge disability, especially mental disorders, fibromyalgia and chronic fatigue syndrome
- Using detectives, friends, co-workers and neighbors of policyholders to attempt to discredit the disability
Claimants also accuse Unum of operating under an inherent conflict of interest. They argue that Unum cannot be trusted to make impartial decisions on claims when it’s the company’s own funds that are used to pay benefits.
Delois raises similar allegations in her own Unum lawsuit. She is seeking compensation for all missed payments, and is demanding a full and fair review of her claim.
