Missouri consumers who purchased Amish Secret Handmade Wood Polish may benefit from a recent class action settlement.

Plaintiff Joanne Miller initiated this false advertising class action lawsuit in March 2016. She claimed that in the course of advertising Amish Secret Handmade Wood Polish, defendant Telebrands Corp. made many false and misleading statements that misrepresented the quality and effectiveness of the product.

Among other claims, Miller alleged Telebrands was in violation of the Missouri Merchandising Practices Act. She also raised a product liability claim on her own behalf and not on behalf of the Class. That claim was resolved through a separate and confidential agreement with Telebrands.

Telebrands denied and continues to deny Miller’s claims. However, the company has agreed to this false advertising class action lawsuit in the interest of avoiding the expense, effort and risk of further litigation.

Under the terms of the settlement, Class Members can receive payments if they purchased Amish Secret Handmade Wood Polish within Missouri and during the applicable class period. Class Members who can submit valid receipts documenting their purchases will receive a higher payment.

Those who do not have receipts to submit can still make valid claims, but they will receive a smaller payment. The settlement administrator will review all claims to determine validity.

The settlement also requires Telebrands to cover the attorney fees for class counsel and an incentive award for named plaintiff Miller.

Class Members who want to object to the settlement or ask to be excluded from its terms, must do so no later than Aug. 15, 2017.

Who’s Eligible

For purposes of this settlement, Class Members eligible to claim benefits include all persons who between Jan. 1, 2014 and Dec. 31, 2016 purchased Amish Secret Handmade Wood Polish within the state of Missouri for their own personal, family or household use.

Potential Award

$10 per bottle.

Class Members who can document their purchases of Amish Secret Handmade Wood Polish with valid receipts can receive payments of $10 per bottle purchased. Those who purchased the product but do not have receipts can receive a payment of $5 per Class Member, regardless of the number of bottles they purchased.

Claims are limited to one per household.

Proof of Purchase

To receive the higher payment of $10 per bottle, Class Members must submit copies of receipts documenting purchases of Amish Secret Handmade Polish during the applicable class period. Credit card statements will not be accepted as valid receipts.

Class Members may file valid claims without such receipts, but those who do will receive a smaller payment.

    Important Notice:

You were directed to WoodPolishSettlement.com from a website that advertises: “We tell you about cash you can claim EVERY WEEK,” or from a site that advertises “free money” for class actions settlements. The operative Settlement Agreement states that Defendants and the Settlement Administrator shall review all claims for validity and for potential fraud.

Please note that in order to collect any benefits under the settlement you are required to sign a form that states: “I certify under penalty of perjury that I purchased Amish Secret Handmade Wood Polish in the State of Missouri on or after January 1, 2014 and on or before December 31, 2016, and that the information stated in this Claim Form is, to the best of my knowledge, true and correct.”
