asbestos-related-diseaseA lawsuit has been filed against several defendants after a man developed asbestos related disease, allegedly through his employment.

Plaintiffs Michael K. and Marina K., a married couple and residents of Chili, Wis., have filed a lawsuit against Weyerhaeuser Company, Metropolitan Life Insurance Company, and unknown insurance companies yet to be determined.

According to the lawsuit, the plaintiff contracted an asbestos related disease through the defendants’ asbestos-containing products.

Asbestos is a group of heat-resistant fibrous silicate minerals that occur naturally as bundles of fibers. They can be woven into fabrics and further used as insulating materials such as in brake linings.

Additionally, the naturally occurring minerals have been used as insulating materials for floor tiles, pipes, stream lines, building materials, and in clutches and brakes.

According to the asbestos lawsuit, defendant Weyerhaeuser Company is the former owner of Marshfield, a “Wisconsin door manufacturing plant where asbestos fireproofing products were manufactured and asbestos products were used in manufacturing production.”

The complaint maintains that the plaintiff, Michael, had inhaled “airborne asbestos fibers.” The lawsuit maintains that Michael’s father Lawrence had worked at the plant and had carried asbestos fibers which may have contaminated through automobiles, homes, and other locations outside the plant.

Michael also alleges he was exposed to airborne asbestos fibers at home, while he lived just over a mile away from the Marshfield plant.

According to the asbestos related disease lawsuit, Michael did not know how to protect himself against the dangers of exposure to asbestos. Allegedly, this asbestos related disease contraction also includes any exposure to asbestos that he may have had outside the plant.

The complaint states that plaintiff Michael “suffers great pain, physical impairment, and great mental pain and anguish. Plaintiffs are liable for large sums of money for medical and hospital care.”

Marina, Michael’s wife, is also a named plaintiff. She files the complaint stating that because of her husband’s asbestos related diseases she has been deprived of the relationship she had previously had with her husband. Among other allegations being made against the defendant she also files the lawsuit purporting that she has lost her husband’s normal services, society, and companionship because of her husband’s injury.

According to the asbestos related disease lawsuit, the direct result of the defendants’ actions resulted in the plaintiff’s contraction of the disease.

Moreover, the serious adverse effects and injury from asbestos exposure starts “soon after inhalation.” However, the asbestos related disease lawsuit maintains that the “signs and symptoms used to diagnose asbestos related disease do not manifest until many years or decades later.”

The couple has brought forth several allegations against the defendants including common law negligence for having asbestos fibers transported or emitted outside the plant, negligent nuisance, intentional nuisance and civil conspiracy, among others.

The plaintiffs are seeking compensatory and general damages, punitive damages, declarations that the actions are unconstitutional, and any additional relief deemed proper by the court.
