If you were arrested and detained by the Chicago Police Department at any time since March 15, 1999, you may be eligible to receive up to $3,000 from a pending class action lawsuit settlement.
The proposed settlement would resolve a class action lawsuit over whether the City of Chicago violated the constitutional rights of certain people who were arrested due to the manner and/or length of their detentions. The lawsuit, Dunn, et al. v. City of Chicago, is separate from the case Portis v. City of Chicago, et al, so the following information is only for those included in the Dunn Settlement. The City of Chicago does not admit any fault under the settlement, but has agreed to create a settlement fund of $16.5 million to resolve the class action lawsuit.
The Dunn v. Chicago Police class action lawsuit settlement includes three classes of persons:
Class I: Those held in a Chicago Police interrogation or “interview” room for more than 16 hours in a 24-hour period at any time form October 21, 2002 to May 14, 2010; or
Class II: Those detained in a Chicago Police Department lock-up or detention facility overnight at any time from October 21, 2002 to May 14, 2010; or
Class III: Those arrested by the Chicago Police Department on suspicion of a felony without an arrest warrant and detained in excess of 48 hours without a judicial probable cause hearing, at any time from March 15, 1999 to February 10, 2008.
Members of Class I are eligible to receive up to $2,000 from the class action settlement, members of Class II up to $90, and members of Class II up to $3,000 from the class action settlement.
In order to receive a payment, you must submit a signed and notarized claim form postmarked no later than October 25, 2010. A final approval hearing will be held October 6, 2010.
