The health benefits of POM Wonderful juice are not as wonderful as the company would like you to believe, says a class action lawsuit filed in Florida.
For over eight years POM has marketed and sold POM Wonderful brand pomegranate (“PWP”) juice as having special health benefits, including the ability to prevent, mitigate and/or treat ailments such as prostate cancer, erectile dysfunction, cardiovascular disease, blood pressure, atherosclerosis, high LDL cholesterol, and other age-related medical conditions. The lawsuit claims this misleading marketing campaign has become so deceptive that in February 2010 the FDA labeled PWP as an unapproved/misbranded drug and misbranded food product. “The claims made by POM that PWP’s intended use is the cure, mitigation, treatment or prevention of disease, violates the Federal Food, Drug and Cosmetic Act.”
“The message is drink PWP and it will keep you young forever. Each person who has purchased PWP has been exposed to POM’s misleading advertising message multiple times,” the lawsuit says.
According to the class action lawsuit, POM misleads and deceives consumers into believing its health claims are backed by science by claiming the company has provided over $34 million in funding to support scientific research on POM products. POM also claims in its advertising and labeling that its products, including PWP, are “backed by $25 million in bullet-proof medical research.”
“[This] implies that PWP delivers the claimed health benefits,” the lawsuit says. “However, POM did not, and has never possessed” the FTC-required scientific evidence for its health claims at the time the claims were made.
Advertising slogans such as “Cheat Death,” “Pure Science,” “Forever Young,” and “Heart Therapy” only further deceive consumers into believing the unproven health benefits of POM Wonderful juice, says the lawsuit. “As a result of this campaign, POM has elevated the product to one of the top sellers in the product category.”
The lawsuit is seeking class certification in addition to damages and restitution to class members who bought POM Wonderful juice. It is also asking that POM engage in a corrective advertising campaign. A copy of the POM Wonderful Class Action Lawsuit can be read here.
