Xarelto-wrongful-death-lawsuitA products liability suit has been filed as part of multidistrict litigation 2592 against Janssen Research and Development LLC, Johnson and Johnson Inc., Bayer Corp., and all affiliated companies involved in research, development, manufacturing, marketing, and promotion of Xarelto, an anticoagulant medication.

Plaintiffs Sandy S., daughter and legal estate representative of her deceased father, Jacob J., filed a new Xarelto wrongful death lawsuit in U.S. District Court for the Eastern District of Louisiana on May 31, 2017. Sandy S. is and Jacob J. was a resident of the State of Washington.

According to the legal documentation, Sandy brings this Xarelto wrongful death lawsuit against the defendants with the belief that they willfully and fraudulently concealed known risks of uncontrolled bleeding associated with the drug.

Because of this, she claims, her father took medication as directed by his physician and experienced intracranial bleeding ending in his death on May 31, 2014.

History of Xarelto

As referenced in the lawsuit, Xarelto, also known generically as rivaroxaban, got its stamp of approval from the Food and Drug Administration (FDA) on July 1, 2011. This approval was for prophylactic use against blood clot formation, Deep Vein Thrombosis (DVT) and Pulmonary Embolism (PE) in the recovery period following total knee or hip replacement surgery.

Later in November of the same year, the FDA decided to expand the anticoagulant’s prescriptive territory to include preventative use with non-valvular atrial fibrillation patients against risk of stroke and systemic embolism. 

Once promotion for the anticoagulant medication began, the defendants in this Xarelto wrongful death lawsuit began to aggressively market the drug as a convenient alternative to warfarin, by the fact that it could be taken once a day and did not need regular blood monitoring.

The fact that there was no antidote for the blood-thinning attributes of Xarelto was carefully minimized by the defendants, the Xarelto lawsuit claims.

Sandy alleges that Xarelto could contribute and even cause uncontrolled internal bleeding. She also points out that there is no available antidote that can reverse the medicine’s effects ─ unlike warfarin, which has a well-established successful history of 40-plus years as a reliable anticoagulant drug therapy. Warfarin’s actions could easily be remedied if necessary by the rapid administration of vitamin K, the lawsuit adds.

According to the plaintiff in this Xarelto wrongful death lawsuit, the drug still does not have adequate warnings that take its propensity to contribute to uncontrolled bleeding with no remedy into account.

To date, there have been six updates to the label on the following dates: August 2013, January 2014, February 2014, March 2014, December 2014, and September 2015.

Counts in Xarelto Wrongful Death Lawsuit

In cooperation with hired counsel, the plaintiff brings the following accusations against the defendants: design defect, manufacturing defect, failure to warn, negligence, breaches of express and implied warranties, fraud, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, violation of Washington consumer protection laws, loss of consortium, and wrongful death.

The plaintiff is asking for a jury to assess punitive and compensatory damages as well as relief from all legal fees, interests, and other costs associated with the lawsuit.

The Xarelto Wrongful Death Lawsuit is Case No. 2:17-cv-05387-EEF-MBN, in the U.S. District Court for the Eastern District of Louisiana.
