Hyundai has agreed to settle a class action lawsuit that alleges the factory-installed flywheel and clutch in 2003 Hyundai Tiburon GTs fail prematurely. If you bought or leased a manual transmission, 2.7-liter engine 2003 Hyundai Tiburon produced on or before April 1, 2003, you may be entitled to a cash payment if the class action settlement is approved.

According to the class action settlement notice, Hyundai was aware that the flywheel and clutch installed in the 2003 Tiburon GT were defective but not only failed to disclose the defect when these vehicles were sold, but also failed to replace the flywheel/clutch parts under warranty.

If you paid for a repair or replacement to the flywheel assembly, clutch disk assembly, clutch cover assembly or clutch release bearing within the 10-year or 100,000 mile warranty period (5 years or 60,000 miles if purchased used), you will be eligible to choose between a cash and non-cash class action settlement option. The cash option consists of a debit card for 100% of the amount paid for the repair. The non-cash option consists of either a debit card equal to 125% of the repair amount redeemable for Hyundai goods and services, or a voucher worth 175% of the repair amount redeemable toward the purchase of a new Hyundai vehicle. The reimbursed amount will be adjusted based on the number of miles your vehicle had at the time of the repair:

0-50 miles = 100% payment

50,001-75,000 = 75% payment

75,001-100,000 = 50% payment

If you made multiple clutch or flywheel repairs, you will need to submit a claim form for each repair. Claim forms (available here) must be postmarked no later than October 26, 2010 or 60 days after the denial of a warranty claim, whichever is later. I bought a used 2003 Tiburon several years ago with about 30K miles on it. Shortly after buying it, I had the clutch go bad and I was told I needed to replace the Dual Mass Flywheel also. After I got the Dealer estimate I searched the internet and found this flywheel to be a problem along with a small valve fitting in the hydrolic line that causes the clutch to release slowly for “easier driving”. This valve actually causes the clutch to wear out prematurly. I replaced my Flywheel with an aluminum Firenze one, an aftermarket clutch, and had that valve removed. I had that work done at about 50K miles. I now have 143K miles on my Tib. and it is still going strong.

When this lawsuit was settled, I produced my receipts for the parts and labor and I believe I got about 75% of all of my costs back.

Hey I just bought my tiburon a couple years ago and i appear to be having the same issues and have paid for repairs that did not even work, possibly because the clutch was an OEM. Is there still anything I can do about this? Am I eligible?

  3. Susan says:

Is there a lawsuit for the 2007 flywheel. My clutch, valves and everything are in very good condition, but the Dual Mass Flywheel is BROKEN. Dealers say no warranty. Mechanic says it is a very poorly designed flywheel and bad manufacturing. I have heard of a lawsuit to help pay repairs but all I see is for the 2003. Is there anyone filing for the 2007 Tiberon?

We purchased a 2003 Tiburon just a few months ago, the car is currently in in the shop for clutch, flywheel and other similar repairs………Given the fact that car was not driven poorly, we began to investigate how this could occur, This is when I stumbled onto the class action lawsuit information.

My question: Are we eligible for reimbursment?
