Burlington Coat Factory of California LLC has agreed to settle a class action lawsuit alleging it used deceptive “Compare” reference prices on price tags which led customers to believe they were receiving a bargain over the same merchandise sold at other retailers.

If you purchased items from a Burlington Coat Factory store in California or purchased products online and had them shipped to a California address from July 1, 2011 through Jan. 26, 2017, you may be entitled to benefits from the Burlington Coat Factory class action settlement.

According to the Burlington Coat Factory class action lawsuit, the “Compare” price tags may have been higher than the actual prices for the same items at other retailers. The plaintiffs claim that Burlington failed to disclose what the “Compare” price actually referenced and therefore failed to provide an accurate basis for consumers to compare prices and products sold at Burlington with those sold at other retailers.

The plaintiff asserts Burlington violated various California laws by using false, deceptive or misleading comparative reference prices on price tags of merchandise sold in California and by failing to inform consumers about its pricing practices. This conduct is also a violation of the Federal Trade Commission Act, according to the Burlington Coat Factory class action lawsuit.

Burlington denies the allegations and maintains it has done nothing wrong. However, the retailer has agreed to settle the fake sale class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who would like to opt out of or object to the Burlington Coat Factory settlement must do so no later than May 30, 2017.

Who’s Eligible

Class Members of the Burlington settlement include anyone who purchased merchandise advertised with a “Compare At” price, an “Our Low” price, or a lower price at a Burlington Coat Factory store in California and/or at its website and had the items shipped to a California address between July 1, 2011 and Jan. 26, 2017.

Potential Award

$5 cash or a merchandise certificate redeemable for $7.50 worth of merchandise from Burlington Coat Factory (a California store or online).

To receive the $5 cash payment, a Class Member must either redeem the merchandise certificate at any Burlington Coat Factory store in California or send a completed Cash Redemption Form to the Claims Administrator (along with the original merchandise certificate).

NOTE: If you did not receive a merchandise certificate in the mail or email, you must file a Claim Verification Form to affirm you purchased one or more products from Burlington Coat Factory with a “Compare At” and “Our Low” price tag from a California Burlington Coat Factory store or you purchased products from the Burlington website and had the products shipped to a California address.
