Owners of a TrueSTEAM Humidifier made by Honeywell may qualify for a cash payment or a new humidifier under the terms of a class action settlement.

Plaintiff Charles Leach of Massachusetts alleges that Honeywell’s TrueSTEAM Humidifiers have a defect that causes them to leak scalding hot water. Leach says he had to lay out towels near his own TrueSTEAM Humidifier to prevent it from causing water damage.

Leach also claims the TrueSTEAM Humidifier is prone to excessive mineral scaling and sediment build-up. He says these problems are the result of defective design and manufacture, and that Honeywell failed to honor its own warranty by remedying the defects.

A federal judge narrowed Leach’s claims in November 2014 on Honeywell’s motion for dismissal. The judge dismissed Leach’s claims for negligent misrepresentation and breach of implied warranty but allowed the action to proceed on other grounds.

Leach was the first of several plaintiffs to bring a defective product class action lawsuit over problems with the TrueSTEAM Humidifier. Plaintiffs Robert Burke and Mark Riley later brought an action of their own in a federal court in Pennsylvania, and three other TrueSTEAM class action lawsuit were initiated in Missouri, Massachusetts and Colorado.

In December 2016, the other plaintiffs sought to temporarily stay their respective actions after Leach reached a settlement in principle with Honeywell that could resolve the claims in all these related actions. These plaintiffs proposed to seek resolution of their own claims through Leach’s settlement, then voluntarily dismiss their own class action lawsuits.

Under terms of the TrueSTEAM class action settlement, qualifying owners of a TrueSTEAM Humidifier may choose to receive a replacement humidifier or a cash payment.

The settlement does not require Honeywell to admit any fault, and the company continues to deny the plaintiffs’ claims.
