Parties have agreed to a TCPA class action settlement that will provide cash payments to persons who received automatically-dialed phone calls from Wells Fargo regarding their student loans.

In this Wells Fargo class action lawsuit, plaintiffs Jesse and John Prather claim Wells Fargo used automatic dialing technology or a prerecorded voice to place phone calls to their mobile phone numbers. The Prathers say they never gave Wells Fargo consent to make such calls, and they allege the bank has been placing similar calls to an entire Class of student loan bank customers.

The Prathers’ claims fall under a federal law known as the Telephone Consumer Protection Act, or TCPA. Among other things, this law prohibits businesses from calling mobile phone numbers using automatic dialing equipment or a prerecorded or artificial voice if the recipient of the call has not granted prior express consent to be contacted in that manner.

The TCPA allows persons who receive such calls to bring a civil claim against the caller. A successful plaintiff may be entitled to statutory damages of $500 to $1,500 for each call that violates the TCPA.

Wells Fargo continues to deny the Prathers’ allegations. The settlement does not require Wells Fargo to admit any fault, and the court has made no decision on liability.

Under the terms of this Wells Fargo class action settlement, the bank will create a settlement fund of more than $2 million. Payments from the fund will be distributed to qualifying Class Members who submit a timely claim. The fund will also be used to cover administrative costs, attorneys’ fees, and a service award to the Class representatives.

Class Members should have recently received a mailed notice that contains a unique claim number. This claim number is necessary to file a claim online. Class Members who did not receive a claim number may file a claim by mail.

Class Members must submit a claim to receive payment. Those who take no action will not receive a payment and will lose their right to bring their own TCPA lawsuit against Wells Fargo over the same issues.

Any settlement funds remaining after claims are paid may be redistributed among Class Members who made claims and cashed their payment checks – giving Class Members even more incentive to submit a valid and timely claim. If distribution of these leftover funds would result in payments of less than $1 per claimant, the funds will instead be donated to the Samuelson Law, Technology & Public Policy Clinic.

Who’s Eligible

Class Members include all U.S. mobile phone subscribers to whom Wells Fargo used automatic dialing or prerecorded voice technology to place a call between April 21, 2011 and Dec. 19, 2015 regarding a student loan, according to Wells Fargo’s records.

    Has anyone received their checks yet? I have not.

    Per settlement website it says, “The Court in charge of this case still has to decide whether to approve the Settlement. Payments will be made on valid and timely claims if the Court approves the Settlement and after any appeals are resolved. Please be patient.”

    I got my check and didn’t cash it and now it’s expired it said void after May 2018 can I get another check issued?
