Joe’s Jeans Inc. and Hudson Clothing LLC have reportedly agreed to settle a class action lawsuit alleging they misrepresented the country of origin of some of their clothing products by claiming they were “Made in USA” even though they contained foreign-made component parts.

If you purchased Joe’s Jeans or Hudson Clothing products between Jan. 7, 2011 and Dec. 31, 2015 that included an unqualified label indicating they were “Made in USA,” you may be entitled to benefits from a class action settlement.

The plaintiffs claim Joe’s Jeans and Hudson Clothing violated California law by labeling and selling products as being “Made in the USA.” According to the Made in USA class action lawsuit, this allegedly improper labeling violated a California false advertising law that prohibits the labeling of a product as “Made in USA” if any foreign-made component is part of the product, even if the product is otherwise designed, produced and manufactured in the United States.

“Consumers generally believe that ‘Made in USA’ products are of higher quality than their foreign-manufactured counterparts,” the Made in USA class action lawsuit states. “Due to Defendants’ scheme to defraud the market, members of the general public were fraudulently induced to purchase Defendants’ products.”

The Joe’s Jeans class action lawsuit asserts that this allegedly deceptive advertising is prohibited by California and federal law.

Joe’s Jeans and Hudson Clothing deny the allegations but have agreed to settle the Made in USA class action lawsuit to avoid the burden and expense of trial. The clothing mislabeling class action settlement was preliminarily approved on March 3, 2017.

According to the Made in USA class action settlement documents, the defendants have agreed to revise their labeling and provide a free tote bag or t-shirt to eligible Class Members who file timely and valid Claim Forms.

The deadline to object to the Joe’s Jeans class action settlement is May 9, 2017. Class Members who would like to opt out of the Made in USA settlement must do so no later than June 20, 2017.

Who’s Eligible

Class Members of the Made in USA clothing settlement include all persons who purchased Joe’s Jeans or Hudson Clothing products in the United States from Jan. 7, 2011 to Dec. 31, 2015, and the products included a “Made in USA” or “Made in the USA” label when they contained foreign-made component parts.

Potential Award

A tote bag or a t-shirt.

Proof of Purchase

Class Members must provide information about their purchase, including the style number or SKU of the clothing item purchased and the approximate date of purchase.

Before submitting a claim, Class Members must certify under the penalty of perjury that they purchased the product and that it bore an unqualified “Made in USA” or “Made in the USA” label.

    I received my Joe’s Jeans tee shirt and it’s horribly mis-cut and deformed. Unwearable, unless I want to look like I have disfiguring lumps along my shoulders. Ridiculous! They obviously sought the cheapest way to fulfill their settlement obligations by creating subpar shirts to send out.
