Simalasan class action settlement

A settlement has been reached in a class action lawsuit that alleges Similasan Corporation made false and misleading representations about some of its homeopathic products.

If you purchased Similasan-brand homeopathic products between Feb. 10, 2008 and April 12, 2017, you may be entitled to compensation from the class action settlement.

The Similasan class action lawsuit was initially filed by plaintiff Kim Allen in February 2012. She, along with two other plaintiffs filed a third amended complaint in October 2013. They allege Similasan manufactures and sells homeopathic products that do not work as advertised.

“Homeopathy seeks to stimulate the body’s ability to heal itself by giving very small doses of highly diluted substances,” the Similasan class action lawsuit says. “However, there is ‘little evidence’ that homeopathy is effective, much less that people understand homeopathic dilution principles.”

According to the homeopathic products class action lawsuit, Similasan claims its homeopathic products work effectively and that they have provided relief to millions of consumers for more than two decades.

The Similasan class action lawsuit explains that homeopathy is based on the principle of similars and the principle of dilutions. According to the principle of similars, a disease can be cured with a substance that produces similar symptoms in a healthy person. Homeopathic remedies are designed to initially aggravate a person’s symptoms, but this fact is not communicated to consumers, the plaintiffs claim.

Under the principle of dilutions, a substance becomes more effective when it is more diluted. “There is a very low probability that even a single molecule of the original substance is present in the Product, but Defendant does not inform consumers of this material fact,” the Similasan class action lawsuit claims.

Similasan denies the allegations and stands by its products. However, the company agreed to settle the homeopathic products class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Similasan homeopathic products class action settlement was preliminarily approved on April 17, 2017.

Class Members who would like to opt out of or object to the Similasan class action settlement must do so no later than July 8, 2017.

Who’s Eligible

Class Members of the Similasan homeopathic products settlement include all consumers who purchased any of the following Similasan homeopathic products in the United States for household or personal use during the period of Feb. 10, 2008 to April 12, 2017:

  • Ear Wax Relief
  • Ear Wax Removal Kit
  • Eye Drops #1
  • Eye Drops #2
  • Eye Drops #3
  • Hay Fever Relief
  • Hay Fever Drops #1
  • Irritated Eye Relief
  • Itch Relief
  • Junior Cold & Mucus Relief
  • Junior Cough & Fever Relief
  • Junior Immune Support
  • Kids Allergy Eye Relief
  • Kids Cold & Mucus Relief
  • Kids Cold & Mucus Relief + Echinacea
Potential Award

A full refund or a cash payment of $5 – $10 (estimated).

The actual amount of compensation each claimant will receive depends on the total number of timely and valid claims that are filed. Note From Claims Administrator May 2017: “Based on current claim numbers, we expect payments to class members without proof of purchase to be up to $5 – $10.”

Proof of Purchase

Class Members who provide proof of purchase for covered Similasan homeopathic products are entitled to a full refund for the products purchased. Class Members who do not have proof of purchase may submit a claim and receive a payment that is estimated to be between $5 and $10.
