A recent class action settlement will offer compensation to waste disposal customers who were charged certain fees by WCA Corporation.
The plaintiffs in this WCA class action lawsuit are customers of the solid waste disposal services provided by WCA and many of its related companies.
They allege WCA improperly billed and collected certain fees from them and many Class Members. One of these fees was billed as an “environmental fee,” and the other was billed as either a “fuel surcharge” or an “energy recovery fee.”
By charging these fees, the plaintiffs claim, WCA breached its contract with them. They allege these fees have no relation to any actual fuel or environmental disposal costs incurred by WCA. The plaintiffs characterize these fees as nothing but “unilateral profit enhancers without any regard to the contractual relationship between the parties.”
WCA continues to deny the plaintiffs’ allegations. The court has made no determination as to liability.
Class Members who want to opt out of or object to the settlement must do so by May 30, 2017.
Who’s Eligible
Class Members include persons throughout the U.S. who, from Nov. 4, 2008 through April 17, 2017 and within the applicable statutory limitations period, paid one or more of the fees at issue to WCA or to one of its related companies.
The applicable statutory limitations period will vary, depending on which state’s law applies to a particular claim.
Potential Award
Varies.
The settlement fund will be distributed on a pro rata basis among all Class Members who submit valid claims. The amount of each payment will depend in part on the number of valid claims received.
Proof of Purchase
Claimants must submit either an online or paper Claim Form to the Settlement Administrator. Claimants may, but do not have to, submit documentation of the amount of fees they paid that may qualify for reimbursement.
