A Virginia woman recently filed a DePuy lawsuit, alleging the medical device manufacturer’s Pinnacle Acetabular Cup System is defective and caused serious injuries.
The plaintiff, Mary S., was implanted with a Pinnacle Acetabular Cup System hip replacement in April 2005. According to Mary’s complaint, the Pinnacle Acetabular Cup System has since led to a number of serious complications, including hip and groin pain, lower back pain, swelling, pseudotumors, and metallosis.
The severity of these complications eventually led to a hip revision surgery in January of this year, and will lead to more surgeries in the future, the hip implant lawsuit alleges.
Mary claims that, had she been properly informed of the known defects of the Pinnacle Acetabular Cup System before she was implanted, she would have chosen an alternative product for implantation and avoided these complications entirely.
Mary filed her Pinnacle Acetabular Cup System lawsuit against DePuy on multiple counts, including negligence, breach of express and implied warranties, negligent misrepresentation, and fraud.
Pinnacle Acetabular Cup System Basics
The DePuy hip replacement device involved in these allegations is the DePuy Pinnacle Acetabular Cup System, also simply known as Pinnacle. The Pinnacle was released onto the market in 2001, and was intended to replace hip joints damaged by a number of conditions.
The DePuy Pinnacle Acetabular Cup System is a widely popular hip replacement option. According to its manufacturers, nearly 150,000 people have gone through a total hip replacement with this particular system so far.
Though DePuy markets its device as safe and effective, hip replacement lawsuits allege that the company is aware of a link between its Pinnacle device and a number of hip replacement problems, including metallosis, toxicity and a high failure rate.
Thousands of lawsuits have so far been filed over serious problems with the Pinnacle Acetabular Cup System. In response, Australia has even taken the DePuy Pinnacle hip devices off their medical market because of its high rate of failure.
