Seagate Settles False Advertising Suit Over Hard Drive Capacity

Seagate, one of the leading manufacturers of computer hard drives, has agreed to settle a class action lawsuit that accuses the company of false advertising and other violations. If you purchased a new Seagate brand hard drive between March 22, 2001 and September 26, 2007, you’re entitled to a cash payment or free software from the settlement.

According to the class action lawsuit, Seagate falsely advertised the amount of storage capacity its hard drives provided and customers received approximately 7% less storage capacity than promised. Seagate denies any wrongdoing in the five-year-old lawsuit, which we first told you about here.

Under the proposed class action settlement, you can receive free backup and recovery software or a cash payment equivalent to 5% of the net amount you paid for any qualifying hard drive you purchased (excluding taxes or rebates). In order to qualify for the cash payment, you’ll have to prove that you bought the hard drive before January 1, 2006 by either providing appropriate documentation or the serial number. Qualifying hard drives must have been bought during the class period, bought brand new, and bought separately — not as part of a pre-installed bundle with a PC or other device.

To receive the software or cash payment, you must submit a valid claim form by July 9, 2010. For more information and to download a claim form, visit www.harddrive-settlement.com. The final approval hearing will be held June 9, 2010.
