Customers of The Body Shop who paid for their purchases with a credit or debit card between Feb. 12, 2011 and March 21, 2017, may qualify for benefits under a recent class action settlement.
Plaintiff Henry Lee claims defendant Buth-Na-Bodhaige Inc., which owns and operates The Body Shop stores, has been producing credit and debit card receipts that display more than the last five digits of the customer’s card number. By doing so, Lee claims, The Body Shop has been violating a federal law that limits the credit card information that may appear on a retail receipt.
Lee’s claims fall under the federal Fair and Accurate Credit Transactions Act, or FACTA. Among many other protections designed to prevent identity theft and credit fraud, FACTA prohibits merchants from distributing electronically-printed credit and debit card receipts that show the card’s expiration date or more than the last five digits of the card number.
Lee originally filed this FACTA class action lawsuit with plaintiff Shane Flaum. Both plaintiffs tried unsuccessfully to litigate their claims together in the same action, but the court split Lee’s and Flaum’s claims into separate FACTA class action lawsuits. Flaum’s claim is now pending in a federal court in Florida.
Under terms of Lee’s settlement, The Body Shop is not required to admit any liability. The court has also made no determination as to liability.
Who’s Eligible
Class Members include persons who, between Feb. 12, 2011 and March 21, 2017, paid for a purchase with a credit or debit card at a The Body Shop retail location in the U.S. and received with that purchase an electronically-printed receipt that displayed more than the last five digits of the purchaser’s credit or debit card number.
Potential Award
$12 gift card.
Proof of Purchase
Class Members who received notice of this settlement via email or mail do not need to do anything to receive their settlement benefit.
Class Members who did not receive notice may submit a Claim Form and a copy of their qualifying The Body Shop credit or debit card receipt to the settlement administrator to benefit from this settlement.

UPDATE September 10, 2019: An Illinois appellate court has overturned The Body Shop FACTA Class Action Settlement. This means that the settlement is no longer valid, and claims will not be paid at this time. The appellate court has instructed the circuit court to review and revise the settlement. UPDATE (11/3/17): Due to certain procedural issues that arose in the federal court, the Class Representative and Class Counsel determined that it was in the interest of the Settlement Class to dismiss the action pending in the United States District Court and to re-file the class action lawsuit in the Circuit Court of St. Clair County, Illinois. The Class Representative will be seeking approval of the settlement from the St. Clair County Circuit Court.
At this point, we do not know whether that court will approval the settlement or when the Settlement Class Members would receive the $12 Gift Card called for in the proposed Settlement Agreement. This website will be updated as soon as additional information is available.

How do you know they are going out of business? I know they keep raising their prices, “sales” are not like they used to be, HATE their new website design, HATE the new product packaging, single new product I was interested in sold out asap, the list goes on. I do live their banana shampoo & conditioner though. And would do anything for a bottle of their old Ice Blue shampoo… Anyways, they’re really closing?
