Parties have reached a settlement in a data breach class action lawsuit against Advance Stores Company Inc., an automotive parts retailer doing business as Advance Auto Parts.
Current and former employees of Advance Auto Parts who were affected by this data breach may qualify for cash reimbursements and free credit monitoring and repair services.
This class action settlement arises out of a March 2016 phishing attack that allegedly exposed the personally identifiable information of several current and former Advance Auto Parts employees. Plaintiffs Jordan Whitehead and Janie Stapleton alleged the attacker convinced an Advance Auto Parts employee to hand over personal information for employees who worked for the company in 2015.
They claim Advance Auto Parts failed to properly safeguard their personal information, and they allege they suffered harm as a result of the attack.
Advance Stores Company continues to deny the allegations. The settlement does not require ASC to admit any wrongdoing, and the court has made no decision as to liability.
Who’s Eligible
The settlement Class includes all current and former Advance Auto Parts employees whose personally identifiable information was exposed in the March 2016 phishing attack.
Potential Award
Varies
All Class Members qualify for free identity protection services provided by AllClear ID. Class Members have been automatically enrolled in AllClear Identity Repair, which provides repair and restoration service in case of identity theft. Class Members have the option of signing up for AllClear Credit Monitoring, a service that includes a $1 million identity theft insurance policy.
Certain Class Members may qualify for partial cash reimbursement for losses sustained due either to tax refund fraud or to unauthorized transfers and identity theft. This reimbursement may cover losses in excess of those covered by the Class Member’s financial institution, their payment card company, and the AllClear Credit Monitoring insurance policy.
Such Class Members who were the victims of tax refund fraud can qualify for up to $750 to cover fees paid to an attorney or certified tax preparer to notify the Internal Revenue Service about the fraud. Class Members who sustained losses due to unauthorized transfers and identity theft may qualify for up to $1,250 in compensation for losses not otherwise covered.
Proof of Purchase
To make a claim, Class Members must print, fill out and mail a Claim Form to the settlement administrator.
Class Members seeking reimbursement must first enroll in AllClear Credit Monitoring and make a claim under that service’s identity theft insurance policy. Those making a Tax Refund Claim must then submit copies of tax paperwork related to the alleged tax fraud. Those making an Unauthorized Transfer and Identity Theft Claim must submit paperwork documenting their relevant losses.
