EOTech class action lawsuit

A settlement has been proposed in a class action lawsuit alleging certain holographic weapon sights manufactured by the EOTech division of L-3 Communications Corporation do not work as advertised.

If you purchased or own certain EOTech holographic weapons sights that were manufactured between Jan. 1, 2005 and Nov. 1, 2016, you may be entitled to a refund from the EOTech class action settlement.

The EOTech class action lawsuit alleges that certain holographic weapons sights made by EOTech were defective in several ways, which affected the performance of the holographic weapons sights under some conditions.

The four issues listed in the EOTech class action lawsuit include “reticle dimming” from moisture incursion, “thermal drift,” parallax, and distortion of the reticle in cold weather.

“As a result, EOTech Sights do not possess the durability, reliability or accuracy represented by Defendants,” the EOTech class action lawsuit states.

The plaintiffs assert that these defects affected the accuracy of their shots.

The manufacturer’s suggested retail price of the EOTech holographic weapons sights named in the class action lawsuit reportedly range from about $300 to $1,500, depending on the specific model and year of manufacture.

EOTech stands by its holographic weapons sights and maintains that it did nothing wrong. However, the company has agreed to settle the class action lawsuit to avoid the distraction and expense of litigation.

The deadline to opt out of or object to the EOTech class action settlement is May 23, 2017.

UPDATE: On Sept. 18, 2017, Top Class Actions viewers who submitted valid and timely claims started receiving checks for the EOTech class action settlement worth as much as $50.

Who’s Eligible

Class Members of the EOTech settlement include U.S. residents who currently own certain EOTech holographic weapons sights models that were manufactured between Jan. 1, 2005 and Nov. 1, 2016 and which were purchased on or before Feb. 15, 2017. You are also a Class Member if you previously received a refund from EOTech for one of these HWS models.

The EOTech holographic weapons sights models covered by this class action settlement include EOTech HWS Models 400, 502, 511, 512, 512 CAMO, 512.XBOW, 512.LBC1, 516, 517, 518, 551, 552, 552.XR, 552.LBC1, 552.LBC2, 553, 555, 555.USMC, 556, 557, 557.4XFTS, 557.4XFXD, 557.3X.FTS, 557.G23.FTS, 558, EXPS2, EXPS3, HHS I, HHS II, MPO II, MPO III, XPS2, XPS2-RF, XPS2-Z, XPS2-Z2, XPS2-300, and XPS3.

Potential Award

Varies.

If you received a refund from EOTech, you will automatically be sent a $22.50 voucher that can be used toward the purchase of a new EOTech product. If your information has changed since you received the refund, you should submit a Claim Form that includes your current information.

Class Members who have not previously received a refund and want to keep their EOTech Holographic Weapon Sight, can receive between $25 or $50 in cash or a $100 voucher for a new EOTech product.

Those who have yet to receive a refund, but now want to return their EOTech product can get a refund up to the MSRP ranging from $299 to $1,179, plus $15 for shipping and a $22.50 voucher.

Proof of Purchase

To receive a refund, Class Members must either return their EOTech sight or submit other documentation including the serial number in order to be eligible for a cash or voucher benefit. Follow the instructions on the Claim Form carefully.

If you have already participated in the EOTech refund program, you do not need to submit a Claim Form, unless your information has changed.

    Just found out about the recall (081620), I’ve been out of the country for 10 yrs, (DoD employee) working abroad, returned two weeks ago and started to get my toys up and running. My 512 has sight issues, large and fuzzy sight picture, no way for me to adjust it.

      I just found out about this too. I, like others on here registered my 516 but was never contacted about this. My sight doesn’t get used a lot but took it out last weekend and it is super dim. Can’t use it outside during the day. I got an email back from them saying they can’t repair it but can get 50% a new sight if I send mine to them. Like I want another one of their sights after all this!!!

      Jesus. Same thing here. I took my old 512 out and it was super dim with new AA battery’s. I will never buy this brand again. Look at a real company likeVortex who stands behind their product. The more we talk about the poor craftsman ship they show the better. Peoples lives depend on this product and it’s not as if it’s cheap.

      I bought an EOTech 553 reflex sight on 4/23/2013 and registered it. I never received notice of the class action either. I am out $680 (plus tax of $56.10). I also see that the model has been discontinued. I bought this sight on EOTech’s reputation. Looks like a big mistake.

    I have 2 model 512’s that don’t work. I just found out today (5/28/2020) about the recall. I purchased both of these sights through a retailer. I sent in the warranty registration so why wasn’t I notified of this buy back/recall?
    I think it’s time for those of us that were never notified by EOTECH to file another lawsuit.

      I just learned from a guy I was going to sell one to. I had no idea either. Bought it new and sent in my card no notification. $650 down the can.

    I own a 512 and I just found out about this as well. What options do I have?

      I called them today and they said the buyback was over a few years ago. If I wanted to fill out a return authorization/repair order, on there website they will get back to me in a few days to offer me probably an expensive repair option, or a 50% off new eotech with return of old holographic.

    I’m in the same boat. Purchased my Holographic hybrid Sight II (HHSII) EXPS2-2 with G33.STS Magnifier on 12/30/2014 from the EOTech sales rep who happened to be in the store that day. I registered the product but was never notified of the recall. Not happy EOTech owner.

    I didn’t know about this recall either. I was advised by range officers in my department I could no longer use the EOTech 557 on my AR-15 at work. I called EOTech and they said it was too late for s refund. Is this correct?
