Clearwire Class Action Settlement Checks Mailed to Happy Consumers

By Sarah Pierce

Clearwire class action settlementSettlement checks went out last week to consumers who submitted valid Claim Forms for the Clearwire telephone call class action settlement (Kwan v. Clearwire Corp.). Class Members are reporting to Top Class Actions that they received checks ranging from $163 to $435 over the weekend – well above the estimated payout for the class action settlement.

Settlement Administrator Garden City Group distributed the Clearwire settlement checks on October 30, about five months after the class action settlement was granted final approval. The payments are part of a deal resolving allegations that Clearwire Corp. placed illegal phone calls to consumers between August 31, 2005, and December 27, 2012, in an attempt to solicit services or to collect debt.

Clearwire denied any wrongdoing but agreed to compensate consumers who received the allegedly illegal cell phone calls. Class Members had until May 27, 2013 to submit a Claim Form to receive a cash award for every improper telephone call they received. [See our claim filing instructions here.]

At the time, we had reported that Class Members could receive between $25 and $100 from the Clearwire telephone call settlement, which was based on information provided by the Settlement Administrator. However, Class Members are reporting to Top Class Actions that they received over $100 in some cases. One reader from Hawaii told us:

“I have been receiving your newsletter for a while now. Thank you so much for what you do. I joined the Clearwire lawsuit and I am surprised and happy to report that I just received a check for $435.42. This check came at just the right time being that we have encountered some trying times. Because of your efforts, I have joined a number of [class action] lawsuits, but this has been the biggest payout for me.”

Congratulations to our Top Class Actions readers who submitted a valid claim for the Clearwire telephone call class action settlement and got PAID! We’d love to hear how much you received in the comments section below.

Get this, I heard about others receiving their checks months ago so I researched and found GCG and called to inquire. They claimed a representative for this claim would contact me in 72 hours. A week later my mother told me I had mail at her business. It was a check for $435. I rushed to the bank deposited it only to have it returned. The bank said the check was “stop payment” and sent me a “Legal copy.” Upon looking at copy the check was dated October 2013 and expired about 6 months later!

I still have not been able to talk to GCG for a replacement check.

I just received a letter stating, respond by 7 days past date, well I only have 2 days. I have bank statements,Clearwire went into my account and stole monies, that was not due to them nor they had no permission too do so, and I’m reading a letter saying I’m not eligible to get my 350$ back!: I’m not done with clear wire, until I get every dime the stole. And the speed suck and I didn’t want they’re service after what was supposed to be a 30 day free trail I mailed the box and software back to them they took money 3 times out my bank account and I was not using they’re service,I been waiting two years for my money!
