Apple Retail Employees File Class Action Over Unpaid Bag Checks

Apple employee class action lawsuitA group of Apple employees is suing their employer in a wage and hour lawsuit, alleging that Apple did not compensate them fully for all the time they spend at work.

The proposed class action lawsuit alleges that Apple requires many of their hourly, non-exempt employees to wait in line and undergo security checks while not clocked in. In these searches, employees’ bags are searched for merchandise. According to the plaintiffs, there is no benefit to the employees for these searchers; it allegedly only benefits Apple. 

Apple retail employees are required to undergo these security checks twice a day to ensure they’re not stealing merchandise, according to the class action lawsuit. On average, employees wait between 10 and 15 minutes for the bag checks. This wait can be even longer if the store is busy, the lawsuit says.

The class action lawsuit alleges that this practice has cost Apple employees millions in dollars in lost wages. Since the employees in question are paid hourly and are considered non-exempt, the lawsuit asserts that this amounts to unpaid hours and unpaid overtime. The employees are seeking the reimbursement of these wages.

This is the second time Apple has been sued this summer over its bag-check policy. Two Apple retail employees in California and New York filed a similar class action lawsuit in July over the policy. 

The latest Apple security check class action lawsuit is brought on behalf of all current and former hourly, non-exempt Apple retail employees who were employed by Apple in the State of Ohio in the past three years, and who were not compensated for the time they spent in security screening lines.

The case is Adam Kilker and Brandon Fisher, et al. v. Apple Inc., Case No. CV 13 3775, United State District Court, Northern District of California.

    This should go for all states the company owes all its retail employees money for these checks, its not right they should compensate everyone that has or is working in the company, managers will find a way to throw out current employees if they attempt to join the claim
