ADT Robocall Class Action Settlement Checks Mailed!

ADT robocall class action settlementPayments for the ADT Security robocall class action settlement were mailed Friday, September 13, according to an update on the Settlement Administrator website. Class Members who submitted a valid Claim Form can expect to see their checks in the mail within 10 business days; many are reporting to Top Class Actions that they’ve already received their payment.

U.S. District Judge Elaine E. Bucklo granted final approval to the class action settlement on June 21, 2013, drawing an end to a 2011 class action lawsuit accusing ADT of violating the federal Telephone Consumer Protection Act. Plaintiffs alleged that ADT called consumers to sell products and services by using an automated dialing machine (“robocalling”) and delivering a pre-recorded message, in direct violation of the TCPA.


ADT maintains it did not violate any laws but agreed to compensate consumers through a $15 million class action lawsuit settlement to resolve the litigation.

Class Members had until June 10, 2013, to file a claim to receive between $50 and $100 cash. This amount was subject to a reduction if more people filed valid claims than what was available in the class action settlement fund. Many Class Members are reporting to Top Class Actions that they received a check for $48.04. Some business owners are reporting payments of $147.50, although this amount has not been confirmed by the Settlement Administrator.

The case is Vishva Desai and Philip J. Charvat, v. ADT Security Services Inc., Case No. 1:11-cv-1925, in the United States District Court for the Northern District of Illinois, Eastern Division.
