Depo testosterone lawsuitA testosterone lawsuit was filed on Jan. 15 under the larger testosterone product multidistrict litigation (or Testosterone MDL), alleging an Oklahoma man suffered bodily injuries from his use of the Depo-Testosterone product.

Depo-Testosterone is a testosterone injection designed, manufactured, and sold by Pfizer Inc. Like many testosterone products currently on the medical market that have also been named as dangerous in various testosterone product lawsuits, Depo-Testosterone allegedly “increases in hematocrit and estradiol in adult males, resulting in thickened blood, the development of blood clots, and heart damage.”

According to the testosterone drug lawsuit, Pfizer neglected to warn the plaintiff, physicians, and other testosterone product users of all the risks associated with Depo-Testosterone.

Plaintiff’s Testosterone Injuries

Plaintiff Wilson B. is a 54-year-old resident of Oklahoma who claims that before his use of the Depo-Testosterone injection, he did not have a history of blood clots or heart problems. Wilson allegedly sought testing and treatment for a low-testosterone (or low-t) condition based on Pfizer’s “direct-to-consumer” low-t awareness campaign.

According the testosterone lawsuit, Wilson began using Depo-Testosterone in July 2011 as prescribed by his doctor. He continued to take the testosterone injection until around March 2013.

A couple months prior, in January 2013, Wilson allegedly began experiencing chest pains. He was hospitalized a day later and diagnosed with a heart attack, which necessitated immediate quadruple bypass surgery.

Wilson alleges in this testosterone product lawsuit that he suffered and continues to suffer injuries and other damages directly caused by his use of the Depo-Testosterone injection, including: cardiovascular impairment, loss of pleasure in life, fear, embarrassment, economic loss, required medical monitoring for heart attacks and other physical injuries, loss of earnings, and medical expenses.

He alleges that had Pfizer fully informed him and his doctor of testosterone side effects associated with Depo-Testosterone, his doctor would not have prescribed it to Wilson and he would never have taken the testosterone injection.

This testosterone lawsuit brings several allegations against Pfizer, including claims of failure to warn, negligence, breach of implied warranty, fraud, negligent misrepresentation, design defect, and punitive damages.

Wilson is seeking relief in the form of general and special damages, payment of loss of earnings and medical expenses incurred by Wilson because of his heart attack, compensation for mental and emotional distress, punitive and exemplary damages, restitution, injunctive relief, and attorneys’ fees to be paid by Pfizer.

This Depo-Tesosterone Lawsuit is Case No. 1:15-cv-00419, filed under the larger Testosterone Product MDL known as In re: Testosterone Replacement Therapy Products Liability Litigation, MDL No. 2545, both in the U.S. District Court for the Northern District of Illinois.
