Top Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Convergent Outsourcing of violating the Telephone Consumer Protection Act by placing unwanted phone calls to consumers’ cell phones.Â
According to comments and posts on the Top Class ActionsFacebook page, Class Members who submitted timely and valid claims for the Convergent class action settlement began receiving checks worth as much as $133.01 on Feb. 2, 2017.
If you filed a claim for the Convergent TCPA settlement, keep an eye on your mailbox because checks are on their way!
The Convergent class action settlement resolves allegations that the company used an autodialer to place robocalls to cell phones without prior express consent.
Under the Telephone Consumer Protection Act, companies are not allowed to call consumers with an automatic dialing system that uses a prerecorded voice message without permission from the call recipient.
This settlement combined several class action lawsuits all claiming Convergent placed more than 500,000 unwanted calls in violation of the TCPA.
Convergent denied the allegations but agreed to pay $5.5 million to avoid the cost and risk of further litigation.
Class Members included U.S. consumers called on their cell phone by Convergent and who:
- Had been reported to Convergent as a wrong number
- Previously requested Convergent not to call such telephone number
- Called after providing to Convergent notice of bankruptcy
- Called after entry by Convergent of an internal attorney handling code
- Had been called on a cell number obtained via third-party skip tracing, on or after Oct. 26, 2008 through May 10, 2016.
The deadline to file a claim for the Convergent robocall class action settlement passed on Sept. 26, 2016.

I havent received my check and today makes 2week,jan 30,2017has passed since checks been mailed out and i live in Illinois/can you all keep me up dated and let me know whats going on?
You should contact the settlement administrator with any questions on the status of your claim. Good luck!
To be fair, many attorneys spend years incurring out-of-pocket expenses for some of these lawsuits with no promise of any reimbursement. I actually think that 33% (not 50 like you claim) is very fair for lawsuits that take years to litigate. Most lawsuits paying out now were filed in 2012-2013. That’s a long time to not know if your work is going to pay off or not. Just filing a lawsuit can cost a few grand. It’s around $400 just to file a lawsuit with the court. It then costs a few extra hundred to have a process server deliver the notice to the defendant. That’s not counting the hours taken up by the attorneys for research and to type up the paperwork. People are actually more than free to opt-out of a lawsuit and then pursue the defendants on their own. I know of someone who frequents the facebook page who did just that for a TCPA lawsuit and received around $10k for a lawsuit that others got $150 for.
I’ve gone to both the TCA facebook page and the page for this lawsuit. Nowhere does a Jennell say that they received a check. A post from a Jennell states that someone received a check for $133. Maybe she saw the facebook post and went to the lawsuit page? Who knows and who cares. I know that I don’t. This lawsuit didn’t require any proof. I stated not once, but TWICE that the claims administrator sent claimant ID numbers to people who qualified based on the call records submitted to them by Convergent. If this woman did get a check, it’s because claim administrator contacted her first. I can assure you that what I am saying is correct because I too received a postcard from them. People who didn’t receive a postcard couldn’t access the claim form. Maybe you should spend your time focusing on reading comprehension skills. It would deem you more useful than worrying about what Jennell or whoever else is doing.
