FedEx Settles Massive Overbilling Class Action Lawsuit

UPDATE 2: A federal judge granted final approval to the FedEx Overbilling Class Action Settlement on Nov. 22, 2013.

 

FedEx Corp. has reached a class action lawsuit settlement over allegations it overbilled for deliveries to business and government offices by charging these customers a higher-priced residential delivery rate. The alleged overcharges cost customers over $5 million in bogus fees, according to the plaintiffs.

A preliminary settlement approval hearing has been set for July 23, 2013.[UPDATE: A federal judge preliminarily approved the class action settlement on August 1, 2013.]


The FedEx overbilling settlement will resolve a class action lawsuit accusing the shipping giant of violating federal racketeering laws by systematically overcharging its business and government customers as much as $3 each for millions of packages. Internal e-mails unsealed in December showed that company executives had known for years about the overcharges – since at least 2008 – but continued to permit the unlawful surcharges to continue “because they generate illicit profits,” the class action lawsuit says.

In one of the emails, a sales executive warns his superiors that “This is a huge class action lawsuit waiting to happen.”

    I was A client of Fedex they shipped our packages,
    I brought A stop of shipping in 2008 when they were billing my card and also sending statements for the same, they claimed We owed them almost 1900.00, but we had card reciepts for the same charges,
    they also owed us A little over 2000.00- for damaged goods for the same time period,
    i recieved A statement for current charges in 2011 for about 100.00 and one this morning 12/05/2013 for 44.56 for 3 items shipped in sept this year, It’s fraud I havent seen A fedex truck i on my docks since I quit doing business with them in 08
    i wish I could recover the money they owe me though,Dale Reece, my number 205-767-9308
