More Hepatitis A Diagnoses May Come After Costco Frozen Berry Recall

Townsend Farms Berry Recall LawsuitViruses can have a long incubation period before symptoms appear, which is why although the Costco Hepatitis A frozen berry recall began on June 4, the outbreak is likely not over. Currently, there are 131 Hepatitis cases linked to Townsend Farms Organic Antioxidant Blend, but more could still come.

The state with the most number of frozen berry Hepatitis A reports is California with more than 60, but states throughout the Southwest and Mountain West have residents who have been afflicted by the disease. While there is a vaccine for Hepatitis A, the disease and its symptoms — including muscle pain, fatigue and various stomach maladies — may not occur for two to four weeks after a person is exposed to it. The vaccine works best if administered within two weeks of exposure to the affected units of Townsend Farms Organic Antioxidant Blend.

 

Company officials and the FDA report that the Hepatitis A outbreak occurred thanks to a shipment from Turkey of pomegranate seeds, and that the agency will now test shipments from the firm involved in shipping the defective products. The Costco Hepatitis A frozen berry recall is not out of the ordinary: a similar outbreak occurred last year and led to numerous diagnoses although it was not reportedly caused by the same importer from Turkey.

Hepatitis A lawsuit attorneys are already investigating claims by several plaintiffs who say that big box retailer Costco and product manufacturer Townsend Farms did not properly monitor the safety of the antioxidant frozen berry blend sold to consumers. It has been reported that the affected products may have been sold for several months, putting customers at risk because of faulty processing that may have included fecal matter contamination or other factors known to be linked to Hepatitis A disease reports.

UPDATE: On Jan. 25, 2016, a federal judge granted class certification in the Costco hepatitis A lawsuit for nine different state subclasses.

UPDATE 2: On Nov. 28, 2016, a group of consumers urged a California federal judge to reject Costco’s motion for summary judgment in a class action lawsuit over frozen berries allegedly contaminated with hepatitis A.

UPDATE 3: On Oct. 31, 2018, consumers were able to get Costco to agree to reimburse medical expenses for those affected by an alleged hepatitis A frozen berry recall, as a part of a class action settlement.
