AppApple class action lawsuitle iPhone and iPod users urged a federal judge on Tuesday to approve a $53 million class action lawsuit settlement with Apple Inc. over claims it wrongfully refused to honor warranty coverage on their devices.

The proposed Apple warranty settlement, which we reported on last month, will resolve allegations raised in multiple class action lawsuits that Apple knowingly used a faulty liquid detection tape in the devices that falsely indicates water damage even when there was none. Plaintiffs say Apple knew the tape could be triggered by humidity and temperature changes, but refused to investigate the true cause of the of the malfunction so that it could deny warranty coverage and force customers to purchase a new or refurbished iPhone or iPod.

The proposed $53 million class action lawsuit settlement will provide cash payments of between $105 and $300 to Apple customers who tried to repair or replace their iPhone on or before December 31, 2009, or tried to repair or replace their iPod Touch device on or before June 30, 2010, and were denied based on Apple’s former Liquid Damage Policy.

Court documents filed May 28, 2013, show plaintiffs are requesting a June 28 hearing to approve the Apple warranty class action settlement.

The case is In re Apple iPhone/iPod Warranty Litigation, Case No. 10-cv-01610, in the U.S. District Court for the Northern District of California.
