Capital One “Best Buy Reward Zone” Credit Card Class Action Lawsuit

Best Buy Reward Zone Credit CardA new class action lawsuit claims Capital One Bank defrauds customers by falsely claiming that its Best Buy co-branded credit cards have no annual fee. Best Buy is not named as a defendant in the lawsuit.

Plaintiff John Graham alleges in the class action lawsuit that he applied for a “no annual fee” Best Buy Reward Zone Credit Card from Capital One but was issued a card that had an annual fee of $39. Disclosures for the credit card clearly stated in large type: “Annual Fee: NONE,” according to the lawsuit.


Graham says had he known there would by an annual fee, he would not have applied for the Capital One Best Buy credit card.

The class action lawsuit is brought on behalf of a nationwide class of all U.S. residents who, between May 8, 2011 and the present, submitted a Best Buy Reward Zone Credit Card Application that contained a “no annual fee” promise but were subsequently mailed a Capital One credit card that had an annual fee.

It is seeking statutory and actual damages, restitution, injunctive relief and more for nine claims, including violations of the Truth in Lending Act (TILA), fraud, and unfair business practices.

The Capital One, Best Buy Credit Card Class Action Lawsuit case is John Graham v. Capital One Bank (USA), N.A., Case No. 13-cv-743, U.S. District Court, Central District of California.
