$4.5M Robitussin drowsiness false ad class action settlement

Haleon has agreed to a $4.5 million class action lawsuit settlement to resolve claims that it falsely advertised its Robitussin products as “non-drowsy” despite containing an ingredient that can cause drowsiness.

The Robitussin settlement benefits consumers who purchased any flavor Robitussin product that includes dextromethorphan and was marketed as “non-drowsy” between Feb. 16, 2016, and Jan. 21, 2025.

According to a Robitussin drowsiness class action lawsuit, Haleon deceptively marketed its Robitussin products as “non-drowsy” despite containing dextromethorphan, an ingredient that can reportedly cause drowsiness. Plaintiffs in the case say they would not have purchased Robitussin products if they knew the truth about the products causing drowsiness.

Robitussin is a cough and cold medicine brand owned by Haleon that offers a variety of products for adults and children.

Haleon hasn’t admitted any wrongdoing, but agreed to pay $4.5 million to resolve the false advertising class action lawsuit.

Under the terms of the Robitussin settlement, class members can receive an equal share of the settlement per claim filed. With proof of purchase, class members can submit up to three claims. Without proof of purchase, class members can submit only one claim. Exact payment amounts will vary depending on the number of claims filed, but class members are estimated to receive between $1.50 and $4.75 per claim.

The deadline for exclusion and objection is April 14, 2025.

The final approval hearing for the Robitussin drowsiness settlement is scheduled for June 30, 2025.

To receive a settlement payment, class members must submit a valid claim form by May 12, 2025.

Consumers who purchased certain Robitussin products containing dextromethorphan and marketed as “non-drowsy” between Feb. 16, 2016, and Jan. 21, 2025.
