The popular clothing store Forever 21 Retail Inc. currently faces a credit card information class action lawsuit alleging that the retail store illegally recorded customer credit card numbers and other sensitive identification information, thus violating California state law.
The Forever 21 class action lawsuit was filed last Friday by California resident Tamar Estanboulian who alleges that this July, she made a purchase at a Forever 21 store located in Los Angeles. As she paid for her purchases at the cashier’s station, a Forever 21 employee asked Estanboulian to provide her email address and failed to inform the plaintiff that this personal identification information was not needed to complete the transaction.
Estanboulian also used a credit card to pay for the clothing items and according to the credit card information class action lawsuit, “[the Forever 21] employee made no attempt to erase, strikeout, eliminate, or otherwise delete Plaintiff’s personal identification information from the electronic cash register after Plaintiff’s credit card number was recorded.”
Tamar Estanboulian claims that during this event, she saw that other Forever 21 patrons were also asked to provide their email addresses and other personal identification information.
According to the Forever 21 credit card info class action lawsuit, the plaintiff alleges that she was led to believe that in order for her to complete the sales transaction and receive a receipt, an email address was needed. Estanboulian further claims that after the sale was completed, she received an unsolicited Forever 21 promotional email.
Estanboulian alleges that through improperly obtaining and storing private credit card and personal identification information of its consumers, Forever 21 has violated the California Song-Beverly Credit Card Act of 1971.
The plaintiff seeks to certify a Class of similarly situated individuals, a statutory damages award of $1,000 to be paid to each Class Member including Estanboulian, payment of attorney’s fees and other legal fees, as well as any other awards deemed fit by the court.
The proposed Class in the Forever 21 credit card info class action lawsuit would include: “all persons in California from whom Defendant requested and recorded personal identification information in conjunction with a credit card transaction within one (1) year of the filing of this case.”
Neither the legal representatives for Estanboulian and the proposed Class or Forever 21’s representatives have replied to a request for comment on the legal proceedings.

This happens all over smh sad
This is one I have a huge problem with. I denied giving them my info and they made it seem as if I had to provide it in order to check out. One time I even seen then keeping tabs on a paper laid next to the register on how many emails they tallied for the day, like trying to reach a quota per employee. I was furious!
