C4, M5 and N0 Extreme Supplement Class Action Settlement

UPDATE: Settlement checks were distributed the first week of September 2013.

 

Woodbolt Distribution – maker of the pre-workout dietary supplements C4 Extreme, M5 Extreme and N0 Extreme – has reached a class action lawsuit settlement over claims it deceptively advertised these products. If you purchased these supplements between 2009 and 2012, you may be eligible to receive an $8 cash payment or free product voucher from the class action settlement.

The Extreme product settlement will resolve a class action lawsuit titled Glover, et al. v. Woodbolt Distribution, Ltd. that alleges the products were deceptively advertised as “dietary supplements” when they did not meet this definition under FDA guidelines. Plaintiffs further alleged that the products are “unsafe” or “dangerous” because they contained the ingredients 1,3 Dimethylamylamine (DMAA) or N-Carbamylglutamate (NCG).

Woodbolt denies the allegations but has agreed to establish a $400,000 class action lawsuit settlement to resolve the litigation.

Class Members of the Extreme supplement class action settlement include all U.S. residents who purchased one of the following products for personal use:

  • C4 Extreme from January 1, 2011 through April 30, 2012
  • M5 Extreme from February 1, 2010 through April 30, 2012
  • N0 Extreme from October 1, 2009 through April 30, 2012


Settlement Class Members that submit valid claims will be eligible to receive either a single cash payment of $8 or a savings voucher for one free product offered for sale on www.Cellucor.com with the purchase of an identical product on the same site.

Woodbolt also agrees under the class action settlement to not include DMAA or NCG as ingredients in the products until October 24, 2015, unless the FDA does not issue an objection to the marketing or sale of products containing these ingredients as dietary supplements.

The only way to receive a cash payment or voucher from the C4, M5 and N0 Extreme class action lawsuit settlement is to submit a Claim Form no later than April 15, 2013.

A Final Approval Hearing is scheduled for April 24, 2013.
