Essure Birth ControlNew Essure lawsuit has been filed against Bayer HealthCare, after a woman alleges her baby was stillborn caused by Essure.

The claim is being filed by the grieving mother, who claims the company is liable for her daughter’s death and should have warned her against potential Essure complications.

Plaintiff Kristina B. is not only filing the lawsuit, but is also helping file a bill that will help a victim’s ability to sue medical device manufacturing companies.

Kristina alleges her daughter Ariel Grace, whom the bill is named after, had been a case of stillborn caused by Essure sterilization effects.

In addition to Bayer HealthCare, Kristina is naming Bayer sales representative Christopher Ford Williams and her obstetric medical professionals as defendants.

In similar lawsuits filed against Bayer HealthCare, the company claims that they are free of liability because a federal agency had approved the device. This defense is known as federal preemption, which the company reportedly hopes will grant them immunity.

According to the Essure lawsuit, Kristina had the contraceptive implanted in December 2013 but soon discovered the product was not working. Medical testing showed that the left fallopian tube was not completely blocked, and had ultimately allowed her to become pregnant.

The Essure birth control device is a permanent contraceptive consisting of two metal coils, each of which are placed in each fallopian tube. After a certain amount of time, the tissue in the fallopian tube is supposed to swell and ultimately block sperm to egg fertilization.

Even with allegations like stillbirth caused by Essure looming, the permanent contraceptive still remains very popular in the United States.

Currently, the Essure birth control device is the only non surgical female sterilization option in America and has capitalized on the conveniences of fast recovery and limited hospital time.

Overview of Essure Stillborn Allegations

Even though she took other contraceptives, Kristina became pregnant and delivered a baby, stillborn caused by Essure, she alleges. She had given birth late at night in June 2015, when she had began bleeding and suffering abdominal pain.

With their child allegedly being a stillborn caused by Essure, Kristina and her husband worked with specialized lawyers to introduced the Ariel Grace law in June 2016. This bill is seeking to amend a certain section of the FDA and Cosmetics Act, which will affect how medical device manufacturers are protected under federal law.

Since the device’s approval in 2002, the Essure birth control has been linked to a number of complications including ectopic pregnancies and miscarriage. Hundreds of Essure lawsuits have been filed throughout the country, from women alleging similar injuries.
