AT&T Automated Call Class Action Settlement

By Mike Holter

AT&TA proposed class action lawsuit settlement has been reached with consumers who received pre-recorded telephone messages from AT&T between 2008 and 2012. If you received a message regarding a long-distance international phone call, you may be entitled to a cash payment of $135 or $270 from the class action settlement.

The AT&T automated call settlement will resolve a class action lawsuit titled Meilleur v. AT&T Corp. that alleges AT&T failed to comply with Telephone Consumer Protection Act (TCPA) and the Washington Automatic Dialing and Announcing Devices Act (WADAD) in its delivery of the following pre-recorded telephone message between July 30, 2008 and May 29, 2012:

“Hi this is AT&T calling with an important message regarding your recent long distance calling. This call is to alert you that someone in your household recently made one or more international calls which will appear on your next AT&T bill at a non-discounted rate. Thank you for using AT&T. Our number is 800-235-9920.”

AT&T denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the AT&T automated call settlement include all persons within the United States who between July 30, 2008, and May 29, 2012 received the telephone call message who had not selected AT&T as their presubscribed long distance carrier at the time of the call, plus all California residents who received the call and were on AT&T’s internal do-not-call list at the time they received the call.

Class Members who received the pre-recorded message identified above may be eligible to receive:

  • a cash sum of $135 if you were NOT a resident of the State of Washington at the time you received the pre-recorded message, or
  • a cash sum of $270 if you were a resident of the State of Washington at the time you received the pre-recorded message.

The only way to get a cash payment from the settlement is to submit a Claim Form either online at www.AutomatedCallSettlement.com or postmarked to the Settlement Administrator by the deadline of May 7, 2013. This deadline may be extended, depending on if and when the settlement is approved.

A Fairness Hearing was held on March 8, 2013. As of March 13, no update has been issued on the settlement website as to whether it was finally approved.

Claim Forms and more information on your rights in the AT&T Automated Call Class Action Lawsuit Settlement can be found at www.AutomatedCallSettlement.com. Detailed claims filing instructions can be found in our Open Lawsuit Settlements section.
