Pfizer agreed to a $35 million Lipitor class action settlement to resolve allegations the company unlawfully kept generic versions of the cholesterol-lowering medication off the market.
The Lipitor settlement includes two classes: the consumer class and the third-party payor class.
The consumer class includes individuals who purchased, paid and/or provided reimbursement for the purchase price of branded Lipitor or generic atorvastatin calcium in Arizona, California, the District of Columbia, Florida, Iowa, Kansas, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, South Dakota, Tennessee, West Virginia or Wisconsin between June 28, 2011, and Nov. 29, 2011, for branded Lipitor or between Nov. 30, 2011, and Dec. 31, 2012, for generic atorvastatin calcium.
The third-party payor class includes entities that purchased, paid and/or provided reimbursement for some or all of the purchase price of branded Lipitor or generic atorvastatin calcium in Arizona, California, the District of Columbia, Florida, Iowa, Kansas, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, South Dakota, Tennessee, West Virginia or Wisconsin between June 28, 2011, and Dec. 31, 2012.
The Lipitor antitrust class action lawsuit alleges that Pfizer and Ranbaxy unlawfully kept generic versions of Lipitor off the market, leading to consumers and third-party payors overpaying for branded Lipitor and generic atorvastatin calcium. The plaintiffs claim that the companies violated state antitrust, consumer protection and unjust enrichment laws by taking actions to delay the entry of generic versions of Lipitor into the market.
Pfizer is a pharmaceutical company that produces a variety of medications, including Lipitor, which is used to lower cholesterol levels.
Pfizer hasn’t admitted any wrongdoing but agreed to pay $35 million to resolve the Lipitor antitrust class action lawsuit.
Under the terms of the Lipitor settlement, class members can receive a payment based on the amount they paid for qualifying purchases of Lipitor or generic atorvastatin calcium. Payment amounts will vary depending on the number of claims filed and other factors. No payment estimates are available at this time.
The deadline for exclusion and objection is Aug. 16, 2024.
The final fairness hearing for the settlement was scheduled for Oct. 1, 2024.
The claim form deadline is Nov. 29, 2024.

The third-party payor class: entities that purchased, paid, and/or provided reimbursement for some or all of the purchase price of branded Lipitor or generic atorvastatin calcium in Arizona, California, the District of Columbia, Florida, Iowa, Kansas, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, South Dakota, Tennessee, West Virginia or Wisconsin between June 28, 2011, and Dec. 31, 2012.

The settlement agreement was finalized and made “Effective” on 10/1/24 by the court. The available timing to appeal expired on 11/4/24 with no appeals filed, while the deadline to submit claims expired on 11/29/24. The court set no specific period for “claims processing” with the administrator citing “several months” being required. Assuming a 6-month time period beginning at the conclusion of claim submissions, a rough but “reasonable date” for payment expectation is 5/29/25.
