Western-Sky-Financial

Western Sky Financial LLC has agreed to a settlement with the state of North Carolina over the online lender’s lending practices. If you took out a loan from Western Sky Financial (also known as CashCall) and you lived in North Carolina at the time, you may be entitled to compensation from the payday loan settlement.

The State of North Carolina filed the payday loan lawsuit against Western Sky, CashCall Inc., WS Funding LLC and Delbert Services Corporation in 2013, accusing them of making illegal loans to consumers in North Carolina.

Western Sky and the other defendants allegedly enticed consumers who needed quick cash to take out disadvantageous loans with excessively high interest rates.

In 2015, a North Carolina judge issued an opinion and order against the defendants, issuing a preliminary injunction to bar them from advertising loans, offering loans, selling or transferring loans to state residents, and/or soliciting or collecting loan payments.

The state’s attorney general subsequently sought to cancel the companies’ existing loans and shut the companies down for good.

The court entered judgment against Western Sky on June 15, 2016. On this date, Western Sky was ordered to immediately cancel any loans covered by the settlement. As a result, North Carolina borrowers are no longer required to make payments on their Western Sky or CashCall loans, and they may be entitled to compensation.

Eligible Class Members should have received a notice about the Western Sky settlement in the mail. According to the class action settlement website, the initial notices were mailed on Aug. 12, 2016. If your address has changed since you took out a loan from Western Sky, contact the Settlement Administrator to update your mailing address.

Who’s Eligible

If you took out a loan from Western Sky Financial (also known as CashCall) and you lived in North Carolina at the time, you are entitled to benefits from the Western Sky settlement.

Potential Award

In addition to receiving cancellation of any loans owned by the defendants, eligible borrowers will also receive a credit history adjustment to remove any information related to the loans.

If you repaid an amount equal or greater than your loan proceeds plus 16 percent interest per annum, you may be entitled to a refund. Refunds will be issued on a pro rata basis.

For those who qualify for a refund, the refund amount is included on the notice and Participation Form documents that were mailed to eligible claimants. Click here to find out how pro rata refunds will be calculated.

N/A. Claimants must enter their 8-digit Claimant ID printed on the Notice Letter. If you did not receive a Notice Letter but you believe you are entitled to a refund from the Western Sky settlement, contact the Settlement Administrator.

    I filed a claim and never received settlement

    In Nevada as well. They offered me a $5000 loan but I only needed $3000. They said I had to take the $5000 in order to get the loan. Only then would they be able to take off the $2000. They didn’t tell me I would be charged a ridiculous interest rate on money they took back. Crooks

    Is there a suit like this in california? They sold my debt after harrasing me at work and calling my boss trying to get personal information on me from him. The 3rd party collector obtainded a judgement against me and i have been trying to settle with them with no luck. Please help
