AllianceOne Text Spam Class Action Lawsuit Investigation

AllianceOne text spamCompanies use a variety of marketing tactics to reach consumers, and one of the more annoying tactics emerging in recent years is through text message advertisements. These text messages are not only bothersome but can also cost the recipient money in the form of wireless carrier charges. They are also illegal to send unless the company has your prior express consent to do so. Many companies have been accused of sending text message spam, including debt collectors, restaurants and banks. One such company may be debt collection agency AllianceOne.

AllianceOne is no stranger to violating the Telephone Consumer Protection Act (TCPA), which prohibits companies from contacting consumers on their cell phones using a variety of means, including using an autodialer or pre-recorded voice message, without the users’ express permission.

Earlier this year, a federal court preliminarily approved a class action lawsuit settlement between AllianceOne and consumers who alleged the company violated the TCPA by robo-calling their cellphones and/or using a pre-recorded voice message.

Now some consumers are complaining that AllianceOne may further be violating the law by sending unsolicited text messages to mobile phone users.

Companies that violate the TCPA must pay the abused consumer $500 per violation or up to $1,500 per violation if the consumer can prove the company knowingly violated the law. Millions of dollars in TCPA class action lawsuit settlements have been awarded to consumers who received text message spam.

    I get unwanted text messages all the time and yes, they do go against your “minutes” but how do you know if it’s Alliance One doing it?
    I am also on a no call list for both my home and cell phone but still get those pre-recorded messages. Again, not sure who they’re from but I think they all should be sued for intruding on my personal time as well as going against the laws for the no call list.
    If anyone knows how to tell if it is Alliance One, please post a comment here.

    Hugo Offender: The, “Can You Hear Me Now, but they don’t!” Perfecto, Verizon! Overchargers and Overlost-Carriers, I wish! All their Reps., argue until they are blue-in-their-face/if I could only reach that far through the phone! Yet, they even have the Boo-Hoo balls to have a collection taken up in their honor via two-four class actions ago, begging their Loyal followers to help raise money over a suit, if they weren’t in the wrong, wouldn’t have to cough up zip, but, settled out of court. What does that say? Interesting how much was raised so their end of the year profit margin would have at least a tiny hump on the graph. Avoiding some slight embarrassment in comparing to their rivals who all are guilty of doing the same crap as well!
