Mesothelioma cancerA woman has filed a wrongful death lawsuit on behalf of her loved one who died as a result of his malignant mesothelioma diagnosis.

Plaintiff Doretha C. filed the lawsuit against 31 companies believed to be responsible for the untimely death of John C. John died in December 2014, just three months after having been diagnosed with malignant mesothelioma.

Doretha’s action is brought forth to recover monetary damages as a result of John’s development of an in curable cancer that resulted from his inhalation of asbestos dust.

According to the lawsuit, John worked as an electrician and the maintenance are three different companies, including Craver Electric Company, R.J. Reynolds Tobacco Company and Piedmont Airlines, Inc.

During his employment with those three companies from 1949 until approximately 1980, John was exposed to asbestos dust and fibers.

“During the time period that [John] was exposed to asbestos dust and fibers, the manufacturers of asbestos products failed to adequately warn of the lethal hazards of breathing asbestos dust, often failing to issue any warning at all, despite the fact that these asbestos companies knew that breathing small amounts of asbestos dust could be fatal,” the lawsuit reads.

What is Malignant Mesothelioma?

Malignant mesothelioma is a cancer of the mesothelial lining of the lungs. It is almost exclusively linked to asbestos exposure, and other causes of mesothelioma are incredibly rare.

Generally, malignant mesothelioma is caused by breathing asbestos dust and fibers. Oftentimes, it takes decades for asbestosis to develop and be diagnosed.

“The scientific and regulatory communities around the world are in unanimous agreement that all types of asbestos released from asbestos products cause cancer, and that there is no safe level of exposure to asbestos,” the complaint states.

Asbestos is a naturally occurring mineral that was used for its superior insulation qualities, as well as fire retardant properties.

In 1980, it was discovered how deadly mesothelioma could be and its use was severely restricted in the United States. However, it has not been totally banned even though it is a known carcinogen.

Allegations in the Malignant Mesothelioma Lawsuit

Doretha has brought forth a number of allegations on behalf of John, including negligence, breach of implied warranty, gross negligence-willful, wanton and reckless conduct and failure to warn.

She alleges that because of the conduct of the companies named in the suit, John developed malignant mesothelioma which damaged him and his heirs.

Doretha is seeking damages associated with hospital and medical expenses, loss of John’s earnings and future earning power, loss of John’s general health, strength and vitality, loss of pecuniary contributions to John’s heirs, loss and future loss of consortium, society, aid, companionship and services to the heirs, pain and suffering of John and any additional damages.

Doretha seeks actual damages, punitive damages, compensatory damages and special damages as allowed and is seeking a jury trial.
