First Arkansas Bank & Trust and Dental Equities LLC have agreed to settle a class action lawsuit accusing them of violating the Telephone Consumer Protection Act (TCPA) by sending fax transmissions related to a “Doctors Club” credit card.
If you received a fax about a “Doctors Club” credit card on or after Jan. 15, 2012, you may be entitled to benefits from the TCPA class action settlement.
Plaintiff Davis Neurology PA alleges that the faxed advertisements for the Doctors Club credit card violated the TCPA because they were sent without the prior express consent of the recipient, and because they failed to include an opt-out notice as required by law.
Davis Neurology asserts that it received an unsolicited fax from the defendants on Dec. 8, 2015, and that the fax did not contain an opt-out notice that is required under the TCPA.
According to the fax spam class action lawsuit, the defendants sent fax transmissions that violated the TCPA to thousands of fax machines. The plaintiff estimates that there may be close to 1 million eligible Class Members.
The defendants deny any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of ongoing litigation.
The defendants have agreed to pay more than $1.5 million to settle the Doctors Club credit card fax spam class action lawsuit.
In addition, the defendants have agreed to stop sending faxes advertising the availability of Doctors Club credit cards without first obtaining the express consent of the recipient or without including the legally required opt-out notice.
The Doctors Club credit card fax spam class action settlement received preliminary approval on Nov. 18, 2016.
If you would like to opt out of or object to the TCPA class action settlement, you must do so no later than Feb. 1, 2017.
Who’s Eligible
Class Members of the fax spam settlement include anyone in the United States who, since Jan. 15, 2012, was successfully sent a fax transmission “advertising the commercial availability or quality of any property, goods, or services by or on behalf of Defendants related to ‘Doctors Club’ credit cards.”
Potential Award
It is estimated that Class Members will receive a payment in the range of $46 to $117. The actual amount each Class Member receives will depend on the number of timely and valid claims that are filed.
