NCO Financial Systems Call Recording Class Action Lawsuit

NCO Financial SystemsA federal class action lawsuit claims debt collector NCO Financial Systems Inc. illegally records cellphone conversations during which personal finance and other sensitive information is discussed without first obtaining their consent.

Plaintiff Mert Erel alleges in the class action lawsuit that he was contacted by NCO in July about an alleged debt the company was attempting to collect from Erel. After speaking with NCO for a period of time about “highly personal and private financial information,” including his home address and social security number, Erel asked if the conversation was being recorded. According to the class action lawsuit, the customer service rep responded for the first time that NCO records all calls it makes to consumers.

“Plaintiff was shocked to discover that such a confidential communication was being monitored, recorded and/or eavesdropped by defendant without plaintiff’s knowledge or consent,” the class action lawsuit states.  

Erel is seeking to represent all California consumers who received cellphone calls from NCO that were recorded without their consent within the past year. It is seeking statutory damages of $5,000 per violation or three times the actual damage per violation, in addition to injunctive relief and damages.

The NCO Call Recording Class Action Lawsuit case is Erel v. NCO Financial Systems Inc., Case No. 13-cv-00317, U.S. District Court for the Southern District of California.

    If they called me I never knew about it because all 1-800, 1-877 number get blocked immediately. They must have given up cause I never answer the phone if a number pops up I don’t know.
