Summit Entertainment Corp., which does business as Gentlemen’s Quarters, has agreed to settle a class action lawsuit alleging it failed to pay some of its workers minimum wage and gratuities.
If you worked as a dancer, entertainer, adult performer or another related job classification at Gentlemen’s Quarters between May 1, 2009 and June 1, 2016, you may be entitled to a cash payment from this minimum wage class action settlement.
Plaintiffs Alyssa Pawelsky and Brianah Tommy filed the Gentlemen’s Quarters class action lawsuit on behalf of themselves and other similarly situated dancers, entertainers and adult performers. They assert that Gentlemen’s Quarters failed to pay them minimum wages and gratuities, a violation of New York State Labor Law.
Summit Entertainment denies the allegations but agreed to pay $2 million to settle the wage and hour class action lawsuit in order to avoid the expense and uncertainty associated with ongoing litigation.
Under the terms of the proposed wage and hour class action settlement, Summit Entertainment will offer a cash payment to eligible Class Members. The amount of the payment will depend on the length of time the Class Member worked at Gentlemen’s Quarters.
Class Members who wish to opt out of or object to the Gentlemen’s Quarters settlement must do so no later than Dec. 31, 2016.
Who’s Eligible
Class Members include anyone who worked as a dancer, entertainer, adult performer or a related job classification at Gentlemen’s Quarters between May 1, 2009 and June 1, 2016.
Potential Award
Varies.
Each Class Member who submits a timely and valid Claim Form will receive a payment equal to 20 percent of the Net Settlement Amount divided by the total number of Class Members.
In addition, the remainder of the Net Settlement Fund will be distributed based on each claimant’s tenure working for Gentlemen’s Quarters between May 1, 2009 and June 1, 2016. This payment will be determined based on a point system. Depending on their tenure during the Class Period, Class Members will be awarded between one and eight points, which will determine the amount of their additional payment.
Proof of Purchase
N/A. However, if you would like to be awarded a higher number of points, you must provide documentation that your tenure at Gentlemen’s Quarters was higher than the defendants’ records reflect.
The Claim Form requires Class Members to provide their Social Security numbers to be eligible for benefits.
