Boyd Biloxi LLC d/b/a IP Casino Resort and Spa has agreed to settle a class action lawsuit alleging it made phone calls using prerecorded messages in violation of the Telephone Consumer Protection Act.

If you received a phone call on behalf of IP Casino Resort and Spa between Oct. 16, 2013 and May 11, 2016, you may be entitled to compensation from the TCPA class action settlement.

Plaintiff Jason Bennett filed the TCPA class action lawsuit in July 2014, accusing the owner of IP Casino Resort and Spa of placing telephone calls with pre-recorded messages advertising free concert tickets and other promotions to consumers who did not provide prior written express consent to receive such calls.

The Telephone Consumer Protection Act is a federal law that was enacted in 1991 to protect consumers from solicitors and telemarketers who contact them without their express permission or consent.

The TCPA prohibits solicitors from placing robocalls, sending unsolicited text messages, calling or texting people who don’t have an established business relationship with the company, contacting consumers on the National Do Not Call Registry, sending unsolicited fax advertisements, and failing to provide an option for consumers to opt out of the unwanted communication.

Boyd Biloxi denies it did anything wrong but has agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

In addition to providing gift cards to Class Members who file timely and valid Claim Forms, the operator of IP Casino Resort and Spa has also agreed to take steps to ensure it does not make advertising or telemarketing calls in the future without first obtaining the written express consent of the call recipients.

Who’s Eligible

Class Members of the TCPA settlement include: “All persons who, since October 16, 2013 through May 11, 2016, received a telephone call to a residential or cellular telephone number initiated by, or on behalf of or at the direction of Boyd Biloxi which used an artificial and/or pre-recorded voice message or was placed by an automatic telephone dialing system.”

Potential Award

$150, in the form of a gift card redeemable at Boyd Biloxi or other Boyd Gaming property (excluding Borgata Casino or any lease outlets or other franchises)

Proof of Purchase

N/A. Claimants must assert under the penalty of perjury that they meet the definition of a Class Member as set forth in this TCPA class action settlement.
