xarelto-bleeding-emergencyA lawsuit has been filed against Janssen Pharmaceuticals and Bayer Healthcare and their related companies alleging their blood thinner drug Xarelto is dangerous to human health.

Plaintiff Karol S. says her deceased loved one, Robert S., was prescribed Xarelto in March 2014 in an effort to reduce the risk of stroke and systemic embolism due to his atrial fibrillation as well as to treat and/or prevent deep vein thrombosis.

In November of that year, Robert was admitted to a hospital in Georgia where he was diagnosed with gastrointestinal bleeding and secondary anemia due to acute blood loss.

He received blood transfusions an additional medical treatment for the next several days. The lawsuit alleges that Robert’s injuries “were directly and proximately caused by Xarelto.”

The lawsuit alleges that Xarelto is dangerous to human health and that the companies engaged in wrongful conduct in all aspects of making, marketing and selling Xarelto.

“Plaintiff maintains that Xarelto is defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce, and lacked proper warnings and directions as to the dangers associated with its use,” the Xarelto lawsuit states.

Studies Suggests Xarelto Is Dangerous to Human Health

Xarelto was initially approved by the FDA in 2011. It is an anticoagulant medication that is used to thin the blood of patients with atrial fibrillation, deep vein thrombosis, pulmonary embolism and is used to prevent stroke and systemic embolism.

The study that was used to secure or FDA approval of Xarelto is known as “RECORD” and stands for Regulation of Coagulation in the Orthopedic Surgery to Prevent Deep Penis Thrombosis and Pulmonary Embolism. “The RECORD studies, however, showed a greater incidence with Xarelto of major bleeding events, leading to decreased hemoglobin levels and transfusion of blood,” the lawsuit states.

Another set of studies, called the EINSTEIN studies, specifically looked at Xarelto in its use to treat deep vein thrombosis (DVT) and pulmonary embolism (PE). With the EINSTEIN-DVT study, researchers found “that Xarelto carried an obvious increased risk of bleeding events as compared to placebo.”

As for the EINSTEIN-PE study, there were reports of “an increased risk of adverse events in users of Xarelto, including those that resulted in permanent discontinuation of Xarelto or prolonged hospitalization.”

The main way that Xarelto is dangerous to human health, according to the Xarelto lawsuit, is with its increased risk of internal bleeding. Patients who experience internal bleeding mostly suffer from bleeding events in the gastrointestinal tract as well as bleeding on the brain following Xarelto use.

“As a result of the foregoing acts and omissions, Plaintiff was caused to suffer serious and did suffer serious personal injuries which are permanent and lasting in nature, physical pain and mental anguish, including diminished enjoyment of life, as well as the need for lifelong medical treatment, monitoring and/or medications,” the lawsuit states.

As a result of Karol’s assertion on behalf of Robert that Xarelto is dangerous to human health, she has brought forth a number of counts against the makers of Xarelto. These include negligence, strict products liability, breach of express and implied warranties, fraudulent misrepresentation, fraudulent concealment and negligent misrepresentation.

Karol is seeking damages for her claims that Xarelto is dangerous to human health, including general damages, medical expenses, pre-and post-judgment interest, refund for purchase costs of Xarelto, consequential damages, punitive damages, attorneys’ fees and costs and any additional relief deemed necessary, just and proper by the Court.

The Xarelto Lawsuit is filed in the Xarelto MDL In re: Xarelto (rivaroxaban) Products Liability Litigation MDL No. 2592, in the U.S. District Court for the Eastern District of Louisiana.
