Birth Control - Dictionary DefinitionBayer HealthCare is facing a new product liability lawsuit from a group of women serious injuries allegedly caused by the Essure birth control system.

Each of these women claim that their injuries were directly caused by the Essure birth control system, and that Bayer HealthCare failed to warn them against any of these complications.

Close to ten women have filed legal action together in this Essure birth control lawsuit, as they experienced similar injuries and had the contraceptive implanted under similar circumstances.

Each of these women had opted for the Essure birth control system for permanent sterilization, and had only used the device for its intended purpose.

The Essure birth control system is the only permanent non-surgical female sterilization method. It has been available since its approval in 2002.

The device consists of two metal coils, each of which implanted into each fallopian tubes. Eventually the tissue will swell around the coils, which prevents sperm to egg fertilization.

Even though this device is highly preferred to tubal ligation, thousands of women have reported Essure complications.

Overview of Essure Birth Control Lawsuit

In all cases for the Essure birth control system in this lawsuit, the contraceptives were implanted by a medical professional and the claimants had no reason to expect complications.

However, the claimants in this Essure birth control lawsuit each suffered permanent injuries, to which the claimants complain still interfere with their daily lives:

The plaintiffs in this case are as follows:

  • Missouri plaintiff Octavia R. had the Essure birth control implanted on Sept. 12, 2012, and had suffered complications soon after.
  • Tennessee plaintiff Jessica A. had the Essure birth control implanted in December 2012, suffering complications not long post-procedure.
  • April A. of Pennsylvania had the Essure birth control implanted in February 2011, and suffered complications soon after the device was implanted.
  • New Jersey plaintiff Madeline B. had the Essure birth control implanted in January 2012, suffering complications soon after the implantation procedure.
  • Indiana plaintiff Sabrina B. inserted the Essure birth control system in October 2010, suffering complications soon after having the device implanted.

Several other women have joined their Essure birth control lawsuit, alleging similar damages and that the device was unreasonably dangerous.

None of these women had received any warnings from Bayer HealthCare regarding potential complications, nor did the company provide any relevant studies.

According to the FDA, over 4,500 Essure birth control injury reports have been submitted since the device’s approval in 2002.

Octavia and her fellow claimants are filing legal action against Bayer HealthCare for failing to warn them against the device’s defective nature. Each of these women state they never would have used the Essure birth control system if they had known the potential dangers.

The Essure Birth Control Lawsuit is Case No. 1622-cc-10519, in the Circuit Court of the City of St. Louis, State of Missouri.

In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
