Wells Fargo TCPA settlement

Wells Fargo Bank NA has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system and/or artificial or prerecorded voice to contact consumers on their cell phones.

If you received a call or text message on your cell phone from Wells Fargo regarding an overdraft between Apr. 21, 2011 and Dec. 19, 2015, and the call or text was made using an automatic telephone dialing system and/or artificial or prerecorded voice, you may be entitled to compensation from the TCPA class action settlement.

Wells Fargo denies that it made any illegal calls or texts but agreed to pay more than $30.4 million to settle the TCPA class action lawsuit.

If approved, the proposed Wells Fargo settlement would resolve a TCPA class action lawsuit filed in April 2015 by plaintiff Kenisha Cross. She claims that she received multiple non-emergency calls from Wells Fargo that were made without her prior express consent.

According to the Wells Fargo class action lawsuit, the calls and text messages were made using an automatic telephone dialing system and/or artificial or prerecorded voice. Cross asserts that these calls and texts violated the TCPA.

The TCPA provides for damages of $500 per violation or up to $1,500 for willful violations. It also provides for injunctions that limit future conduct from those found to have violated the TCPA.

If you would like to object to or exclude yourself from the Wells Fargo TCPA class action settlement, you must do so no later than Dec. 16, 2016.

Who’s Eligible

Under the terms of the Wells Fargo TCPA settlement, Class Members are defined as: “all users or subscribers to a wireless or cellular service within the United States who used or subscribed to a phone number to which Wells Fargo made or initiated one or more Calls during the Class Period, in connection with overdrafts of deposit accounts, using any automated dialing technology or artificial or prerecorded voice technology, according to Wells Fargo’s available records.”

The Class Period is Apr. 21, 2011 through Dec. 19, 2015.

Potential Award

$25 – $70 (estimated)

The actual amount each claimant will receive depends on the total number of valid and timely claims filed by all Class Members.

    Your kidding me people are getting checks for only 42.00 dollars ? Omg what a joke the lady I spoke to said it was being paid for their wrong doing and inconvenience and because it’s the point of the matter not just what you got charged by accident omg and the attorneys are getting everything they need to be sued seriously they lied

    I received 2 checks within 2 weeks apart from each other. I threw both of them away in the trash. Total of both checks : $ 10.00. I have been paying Wells Fargo mortgage since 2002. Not once have they done anything for me except take my money. Thank you W.F. for your customer service.

    I received mine, for $47.67, I haven’t cashed it though yet. Honestly, I do not see the watermark on the back so it concerns me, I do not want to try to cash it and if it isn’t legit get in any trouble.
