MAPCO class action settlement

A settlement has been reached in a class action lawsuit involving a data breach disclosed by MAPCO Express Inc. on May 6, 2013. The data breach reportedly caused individuals to have their personal and financial data stolen from MAPCO’s data systems.

If your personal or financial data was stolen from MAPCO’s data system and you were damaged as a result of the data breach, you may be entitled to benefits from the MAPCO data breach class action settlement.

The MAPCO class action lawsuit was filed in August 2014 by plaintiff Mandi Phillips and accused MAPCO of negligently failing to prevent the data breach.

She says her personal and financial information was compromised as a result of a data breach that affected MAPCO Express convenience stores.

The data breach class action lawsuit asserts that MAPCO intentionally and negligently violated the Fair Credit Reporting Act. The plaintiffs also assert claims for negligence and the invasion of privacy by public disclosure of private facts.

MAPCO denies any wrongdoing but agreed to settle the data breach class action lawsuit to avoid the cost and risk of ongoing litigation. The MAPCO class action settlement was preliminarily approved on Sept. 14, 2016.

In addition to offering compensation to eligible Class Members, the data breach settlement also requires MAPCO to provide significant non-monetary relief. MAPCO will improve its data security measures and implement reasonable safeguards to control information security risks. It will also provide security training to its employees.

Class Members who would like to object to or exclude themselves from the MAPCO data breach settlement must do so no later than Dec. 19, 2016.

Who’s Eligible

You are a Class Member of the MAPCO data beach class action settlement if:

  • You are a resident of the United States or a U.S. territory;
  • You made a purchase at a MAPCO store with a credit or debit card at any time between Mar. 1, 2013 and Apr. 30, 2013;
  • You are responsible for the charges on that credit or debit card; and
  • You suffered losses due to the data breach, such as out-of-pocket expenses, unreimbursed fraudulent charges, or time spent dealing with issues related to the data breach in order to prevent further damages or losses.
Potential Award

Up to $500.

The amount each Class Member receives will depend on the losses suffered due to the MAPCO data breach. Payments may be reduced on a pro rata basis depending on the total number of claims that are approved.

Proof of Purchase

Class Members must provide documentation of the losses suffered.

If claimants are unable to provide documentation, they may self-certify the time they spent dealing with issues related to the data breach, but they will only be able to claim up to two hours at a rate of $15 per hour.

Class Members who do have documentation of their time spent dealing with issues related to the data breach can claim up to five hours of time at a rate of $15 per hour.
