Appstack class action lawsuit

Appstack Inc. has reached a settlement over allegations it violated the Telephone Consumer Protection Act (TCPA) by using a prerecorded voice to call consumers on their cell phones.

If you received a call on your cell phone from or on behalf of Appstack since Aug. 27, 2009, you may be entitled to compensation from the TCPA class action settlement.

The Appstack class action lawsuit asserts that Appstack violated the TCPA by making calls to cell phones using a prerecorded message. The plaintiffs claim that Appstack did not have the recipients’ prior express consent to receive these calls.

The TCPA is a federal law that prohibits companies from contacting consumers using an automated dialing system and/or prerecorded or artificial voice without first obtaining their consent. Violations of the TCPA can range from $500 to $1,500 per unsolicited call or text.

Appstack denies all allegations of wrongdoing in the TCPA class action lawsuit. However, it has agreed to a class action settlement in order to avoid the expense and uncertainty of ongoing litigation.

In addition to providing compensation to eligible Class Members, the Appstack defendants have also agreed to make changes to their telemarketing activities to ensure they are compliant with the TCPA.

Class Members who wish to exclude themselves from or object to the Appstack TCPA class action settlement must do so no later than Nov. 28, 2016.

Who’s Eligible

You are a Class Member if, on or after Aug. 27, 2009, you received a call on your cell phone with a prerecorded message that was made by or on behalf of Appstack.

Potential Award

$40 – $100 (estimated).

The amount each claimant receives will depend on the total number of Claim Forms that are submitted by Class Members.

N/A

When filing a Claim Form, Class Members must provide the phone number at which they received a call from Appstack and the Unique Identifier, which was sent to Class Members via a postcard notice.

    Why I did not receive form for putting numbers on I had so many and no postcard I filed a claim.

    I’ve received hundreds of robocalls. How do I know if one of those was generated by Appstack? The names do not show on my phone and they do not identify themselves as being from that company.
