benicarA new lawsuit has been filed within the Benicar MDL currently underway in federal court in New Jersey.

This most recent addition to the thousands of other legal complaints has been filed by a woman who alleges she suffered severe personal injury, according to her Benicar diarrhea lawsuit.

Plaintiff Mary J. Is a resident of Oklahoma who is 65 years old. She claims she suffered injury to herself as well as economic loss as a result of taking Benicar to treat her high blood pressure.

According to her Benicar diarrhea lawsuit, Mary began taking Benicar in 2011.

Shortly thereafter she suffered a number of physical injuries including, but not limited to: diarrhea, fatigue, nausea, vomiting, bloating, hypokalemia, gallbladder removal, abdominal pain, chronic upper respiratory infections, dehydration and weight loss of greater than 20 pounds

As a result of her alleged injuries, Mary has brought forth a number of counts against Benicar’s manufacturer, Daiichi Sankyo including products liability for design defect and failure to warn, multiple counts of negligence, multiple counts of fraud, breaches of express and implied warranties, unjust enrichment, violation of Oklahoma state consumer protection laws and punitive damages.

Mary is seeking a trial by jury and seeks relief and judgment against the manufacturers for compensatory damages, punitive damages, interest, costs of suit and any other relief deemed appropriate by the Court.

Benicar Use and Side Effects

Benicar is a prescription pharmaceutical that is used to reduce blood pressure in individuals with hypertension. The medication was initially approved by the FDA in 2002.

By dilating the blood vessels in the body, Benicar works by allowing the blood to have more space to flow freely, reducing the amount of pressure in the blood vessels, and subsequently reducing the amount of strain placed on the heart.

As with any prescription or over-the-counter medication, Benicar comes with known side effects. Mild side effects seen with Benicar use include joint pain, muscle pain, lightheadedness or dizziness, weakness, mild itching and upper respiratory infections.

As in the case with Mary’s Benicar diarrhea lawsuit, more severe side effects may also ensue. Benicar is known to have severe gastrointestinal side effects linked with its use.

The Benicar-associated diarrhea is not the typical diarrhea that may be experienced when starting a new medication or with an acute infection.

Benicar diarrhea is chronic, unrelenting and life-changing in that it can severely restrict a person’s ability to travel outside the home for work or leisure due to its severity.

Additionally, Benicar diarrhea can lead to severe dehydration, electrolyte imbalance, malnutrition and malabsorption of nutrients. At time, this condition can be so severe that hospitalization is required to bring the patient back to a healthier state.

Severe abdominal pain is also linked to Benicar use. The pain and related symptoms often appear like celiac disease, a severe allergy to gluten, which is a protein found in wheat, barley and rye.

However, most patients test negative for celiac disease but are found to have similar conditions and are diagnosed with villous atrophy or sprue-like enteropathy.
