Consumers who ended up paying for unwanted credit monitoring through One Technologies Inc. may have a refund coming to them, according to an announcement from the Federal Trade Commission.
The refunds are the result of a $22 million settlement reached in 2014, requiring the company to issue partial refunds to affected consumers.
The settlement wraps up a joint enforcement action brought in conjunction with the governments of Ohio and Illinois over allegations that One Technologies signed consumers up for paid credit monitoring services without their consent.
According to the FTC, One Technologies lured consumers in with offers to provide them their credit scores at no charge.
The company allegedly promoted this offer through at least 50 websites, including FreeScore360.com, FreeScoreOnline.com, and ScoreSense.com.
What One Technologies didn’t make clear to consumers was that after getting their credit score, they would automatically be signed up for ongoing credit monitoring services known as MyCreditHealth and ScoreSense.
These services came at a cost to the consumer of $29.95 per month, according to the FTC.
Consumers supposedly had the option of canceling the service via phone, but the FTC says some had to call multiple times to get the cancellation to take effect.
One Technologies also denied refunds to many who requested them, the FTC says.
The FTC lawsuit alleged One Technologies violated the Federal Trade Commission Act, the Illinois Consumer Fraud Act, the Ohio Consumer Sales Practices Act, and related state rules.
Almost $20 million of the settlement amount will be distributed to affected persons in the form of refund checks.
In addition to issuing partial refunds, the settlement also requires One Technologies to get consumer’s consent before billing them for services.
The company must also provide customers with an easy way to cancel their service.
The FTC says it began sending out refund checks on Sept. 27.
Affected persons should have received Claim Forms that were previously mailed out by the FTC. These forms must have be filled out and returned before the stated deadline to get a refund.
Refund administrator Analytics LLC will handle the distribution of checks. Refund amounts generally range from $90 to $150. Recipients will have 60 days in which to cash their checks.
The FTC notes that it never requires persons to pay money or disclose personal information in order to cash a refund check.
Thanks to a federal law called the Fair Credit Reporting Act, consumers are entitled to at least one free copy per year of their credit reports from each of the three major reporting agencies – Equifax, Experian and TransUnion.
The FTC is in charge of enforcing the FCRA regarding these reporting agencies.
Only one website is authorized to provided free credit reports under this program, at www.AnnualCreditReport.com. The FTC says other websites that claim to offer free credit reports, free credit scores, or free credit monitoring are not part of the annual free credit report program provided for by federal law.
Some of these websites are impostor websites that attempt to sell consumers paid services other than the free credit report they’re looking for. According to the FTC, websites like these may also use URLs that purposely misspell “AnnualCreditReport.com” to mislead consumers.
