A settlement has been proposed in a class action lawsuit alleging Catalina Channel Express Inc. printed credit and debit card expiration dates on customer receipts in violation of the Fair and Accurate Credit Transactions Act (FACTA).
If you made a credit or debit card purchase at any Catalina Express ticket counter location and received a receipt that included the payment card’s full expiration date, you may be entitled to compensation from this FACTA class action settlement.
FACTA is a federal law that prohibits any credit and debit card receipts provided to a customer at the point of sale from displaying any more than the last five digits of the payment card number and/or the expiration date of the payment card.
In the FACTA class action lawsuit, plaintiff Larry Tran alleges that Catalina Express did not comply with FACTA because the expiration date of credit and debit cards was displayed on receipts that were handed to customers at Catalina Express ticket counter locations between Mar. 6, 2013 and Mar. 9, 2015.
Catalina Express denies any wrongdoing and maintains that it did not violate FACTA. However, the company has agreed to settle the class action lawsuit to avoid the time, cost and uncertainty of ongoing litigation.
The Catalina Express class action settlement was preliminarily approved on Apr. 4, 2016.
Who’s Eligible
Class Members of the Catalina Express settlement include all U.S. residents who, at any time between Mar. 6, 2013 and Mar. 9, 2015, made a debit card purchase at any physical Catalina Express ticket counter and were given a printed receipt that included the expiration date of that credit or debit card.
Catalina Express ticket counters are located in the following California cities: Avalon, Dana Point, Long Beach, San Pedro and Two Harbors.
Potential Award
Maximum of $250 or $500 per credit/debit card, depending on the type of claim filed.
Class Members who file a claim for Actual Damages may be eligible to recover up to $500, subject to a pro rata reduction.
Class Members who do not claim actual damages may be eligible to recover up to $250, subject to a pro rata reduction.
Proof of Purchase
Claimants must provide proof that they made a purchase from Catalina Express with a credit or debit card. This may include a copy of a receipt or a debit/credit card statement.
When submitting a statement, you may redact all information except the following: name, address, the last four digits of your account number, and the date and amount of your purchase from Catalina Express.
Claimants who file a claim for actual damages must provide proof of the actual damages they suffered.
