The eBay settlement resolves allegations that the online auction website removes “Buy It Now” listings when a prospective buyer clicks on that option, even if they eventually revoke their offer.

Plaintiff Luis Rosado claims that not only did eBay not re-list the item, they also kept the fees charged for the “Buy It Now” option.

Class Members of the eBay class action settlement included all eBay sellers in the U.S. who experienced a buyer backing out of a “Buy It Now” listing between July 30, 2007 and Sept. 10, 2015 and were not refunded listing fees.

According to court documents, out of 2.5 million possible Class Members more than 30,000 submitted Claim Forms before the settlement deadline.

eBay attempted on numerous occasions to dismiss the class action lawsuit arguing that its terms of service that sellers agree to explains its no-refund and listing policies.

The company eventually decided the settle the allegations by paying $1.2 million to avoid the expense and risk of further litigation.

The deadline to file a claim for the eBay class action settlement passed on Dec. 8, 2015.
