A settlement has been reached in a class action lawsuit alleging certain individuals who were charged with non-indictable offenses were unlawfully strip searched at the Union County Correctional Facility in New Jersey.

If you were admitted to the Union County Correctional Facility on a non-indictable offense between May 1, 2006 and June 30, 2008, you may be entitled to payment from this class action settlement.

The Union County strip search class action lawsuit alleges that the booking procedures at the Union County Correctional Facility constitute an unlawful strip search of individuals admitted to the facility without reasonable suspicion to believe they were concealing contraband.

The defendants deny the allegations but agreed to settle the class action lawsuit to avoid the risk and expense of trial. They have agreed to establish a fund of $2.3 million to resolve the litigation, which was initially filed in February 2008.

The unlawful strip search settlement was preliminarily approved on July 14, 2016. According to settlement documents, there are 7,620 strip searches that qualify for benefits from the Union County class action settlement.

If you wish to exclude yourself from or object to the Union County class action settlement, you must do so no later than Nov. 14, 2016.

Who’s Eligible

Class Members include: “All persons who were placed into the custody of the Union County Correctional Facility as a result of a non-indictable matter and were strip searched in the absence of reasonable suspicion upon their entry into Union County Correctional Facility pursuant to the policy, custom and practice of the County of Union. The class period commences on May 1, 2006 and extends until June 30, 2008.”

NOTE: The class action settlement does not offer benefits to individuals who were charged with a crime subject to punishment of more than six months and for which there is a right to indictment.

    I have also filled out the paperwork for Union County Correctional facility AND Essex County Correctional facility and I have NEVER been contacted since returning the paperwork. Can I get an explanation on this? I had revisited one of the worst times of my life and admitted being in those places alone with the stigma that comes with it! Added to the fact that My family wears Blue! I’m the daughter of a NJ State Trooper (Sergeants ret), the niece of a Secret Service Agent (ret), Chief of Police & approximately 15-20 cousins (1st, 2nd, etc..) whom were/are Officers in various cities, towns, states, ranks… More is expected of you. So it made it harder for me to open that up. I’d really like to know why I didn’t even get a letter telling me to go to hell! Please enlighten me? I would sincerely appreciate it.
